• <br /> 2. Any applicant required to submit data for the Draft EIS shall be <br /> deemed to have fulfilled the requirements of this Ordinance by <br /> utilizing the services of a consultant included upon the respon- <br /> sible consultants' list, PROVIDED, that the Responsible Official <br /> delay distribution of the Draft EIS, when necessary, to correct <br /> any deficiencies in the data submitted and that the consultant <br /> shall provide such information as is required under Section 11-A <br /> of this Ordinance. <br /> Section 5: Section ll-C(4) of Ordinance No. 406-76 which reads as follows: <br /> 4. The Responsible Official shall accept for inclusion upon the <br /> certified consultant list any person, firm, corporation, partner- <br /> ship or association which: <br /> a. Documents it expertise in engineering, planning, <br /> biology, zoology, geology, and other areas of analysis <br /> under WAC 197-10-444. <br /> b. Where the firm has had previous experience, provides <br /> one or more recommendations from the lead agency in- <br /> volved in the prior experiences. <br /> is hereby amended to read as follows : <br /> 4. The Responsible Official shall accept for inclusion upon the <br /> responsible consultant list any person, firm, corporation, <br /> partnership or association which: <br /> a. Documents its expertise in engineering, planning, <br /> biology, zoology, geology, and other areas of analysis <br /> under WAC 197-10-444. <br /> b. Where the firm has had previous experience, provides <br /> one or more recommendations from the lead agency in- <br /> volved in the prior experiences. <br /> Section 6: Section 11-C(5) of Ordinance No. 406-76 which reads as follows: <br /> 5. The Environmental Review Committee may, upon notification to <br /> an affected firm, remove said firm from the consultants' list for <br /> good cause, including incompetence, misrepresentation, insuf- <br /> ficiency, bias, or gross failure to perform in accordance with <br /> this ordinance. The firm shall have the opportunity to present <br /> arguments to the Committee prior to Committee action. A motion <br /> for removal shall require five affirmative votes . The firm may <br /> apply for reinstatement to the consultants' list after one year <br /> and shall be reinstated upon approval by a majority of Committee <br /> members . <br /> is hereby amended to read as follows : <br /> -5- <br />
