Select a list of qualified consultants for EIS preparation. <br /> is hereby repealed. <br /> Section 11: Section 19 of Ordinance No. 406-76 which reads as follows : <br /> Section 19: Appeal Procedures <br /> A. The following City determinations and actions shall be subject to <br /> review on appeal by the Environmental Review Committee: <br /> 1. A determination whether or not a project or proposal is an <br /> "action"; <br /> 2. A determination as to scope of the total proposal; <br /> 3. A determination whether or not a project or proposal is <br /> categorically exempt; <br /> 4. A threshold determination; <br /> 5. Adoption of the final EIS, as to adequacy; <br /> 6. Final action on a project or proposal, as to compliance <br /> with the provisions of this ordinance. <br /> B. Any interested person shall have the right to appeal any of the <br /> determinations or actions described in Subsection (A) above. <br /> There shall be no right under this section to appeal to the Environ- <br /> mental Review Committee any decisions of the City Council nor to <br /> appeal those actions where an appeal is otherwise provided for or <br /> prohibited by the City Charter, other City Ordinance or State law. <br /> C. Notice of all determinations and actions described in Subsection (A) <br /> above shall be filed immediately by the Responsible Official in the <br /> City's SEPA Public Information Center. Any appeal from such a <br /> determination or action must be filed in writing with the Environ- <br /> mental Review Committee no later than the fifteenth day <br /> following the filing of such determination or action and shall set <br /> forth in a clear and concise manner the errors complained of. <br /> -7- <br />
