I <br /> 1 solely and completely responsible for the conditions of the project site, including safety ' <br /> 2 for all persons and property in the performance of the work. This requirement shall <br /> 3 apply continuously, and not be limited to normal working hours. The required or implied <br /> 4 duty of the Engineer to conduct construction review of the Contractor's performance <br /> 5 does not, and shall not, be intended to include review and adequacy of the Contractor's <br /> 6 safety measures in, on, or near the project site. <br /> 7 <br /> 8 <br /> 10 (April 3, 2006) <br /> 11 Confined Space <br /> 12 Confined spaces are known to exist at the following locations: <br /> 13 <br /> 14 *** Storm water and sanitary sewer structures and other utility vault facilities *** <br /> 15 <br /> 16 The Contractor shall be fully responsible for the safety and health of all on-site workers <br /> 17 and compliant with Washington Administrative Code (WAC 296-809). <br /> 18 <br /> 19 The Contractor shall prepare and implement a confined space program for each of the <br /> 20 confined spaces identified above. The Contractors Confined Space program shall be <br /> 21 sent to the Contracting Agency at least 30 days prior to the Contractor beginning work in <br /> 22 or adjacent to the confined space. No work shall be performed in or adjacent to the <br /> 23 confined space until the plan is submitted to the Engineer as required. The Contractor <br /> 24 shall communicate with the Project Engineer to ensure a coordinated effort for providing <br /> 25 and maintaining a safe worksite for both the Contracting Agency's and Contractor's <br /> 26 workers when working in or near a confined space. <br /> 27 <br /> 28 All costs to prepare and implement the confined space program shall be included in the <br /> 29 bid prices for the various items associated with the confined space work. <br /> 30 <br /> 31 -f3 <br /> 32 1-07.2 State Taxes <br /> 33 <br /> 34 Delete this section, including its sub-sections, in its entirety and replace it with the following: <br /> 35 <br /> 36 1-07.2 State Sales Tax <br /> 37 (June 27, 2011 APWA GSP) <br /> 38 <br /> 39 The Washington State Department of Revenue has issued special rules on the State <br /> 40 sales tax. Sections 1-07.2(1) through 1-07.2(3) are meant to clarify those rules. The <br /> 41 Contractor should contact the Washington State Department of Revenue for answers to <br /> 42 questions in this area. The Contracting Agency will not adjust its payment if the I <br /> 43 Contractor bases a bid on a misunderstood tax liability. <br /> 44 <br /> 45 The Contractor shall include all Contractor-paid taxes in the unit bid prices or other <br /> 46 contract amounts. In some cases, however, state retail sales tax will not be included. <br /> 47 Section 1-07.2(2) describes this exception. <br /> 48 <br /> 49 The Contracting Agency will pay the retained percentage (or release the Contract Bond <br /> 50 if a FHWA-funded Project) only if the Contractor has obtained from the Washington <br /> 51 State Department of Revenue a certificate showing that all contract-related taxes have <br /> N.
