The monopole has been proposed to be located adjacent to Interstate 5 <br />right-oF-way. With the dense buffer of �vergreen trees , it will not have a <br />significant impact tliat wiil disrupl residential neighborhoods adjoining the <br />area. The siting is consistent with Policy 3B(4) of the Utilities and Capital <br />Facilities Policies of the Everett Comprehensive Plan. (Exhibit 1, Siddiq <br />festimony) <br />26. It would be impractical to underground the structure. The very nature� of <br />ihe facility and the need for a"line of site" necessitates that the structure <br />be above ground. (Exhibit 1, Siddiq testimony) <br />27. In addition to the Special Property Use Permit, the Applicant must also <br />secure a variance Yo raise the height of the antenna io exceed the 35 <br />foot height limit imposed for R-3 zoned properties. The criteria for <br />variances as set forth in EMC 19.41.130.0 are: <br />(a) That ihe variance is necessary because of exceptional or <br />extraordinary circumstances regarding the size, shape, topography, or <br />location of the : ubject property; or the location of a pre-existing <br />improvement on the subject property that conformed to tho Zoning Code <br />in effect when the improvement was constructed. <br />(b) That the variance will not be materially detrimental to the property <br />in the area of the subject property or to the City as a whole. <br />(c) That the variance will only grant the subject property the same <br />general rights enjoyed by other properly in the same area and zone as <br />the subject property. <br />(d) That the variance is the minimum necessary to aliow the subject <br />property the genoral rights described in Criterion C. <br />(e) The granting oi the variance is consistent with the Goals and <br />Policies of the Everett General Pian. <br />(f) The need for the requested variance is not the result of a self- <br />created liardship. <br />s� <br />'i•� <br />
