I <br /> DOCUMENT 00 21 13-INSTRUCTIONS TO BIDDERS <br /> I <br /> 1.1 BID SUBMISSION <br /> A. Bids submitted after the Bid Opening time noted in the Advertisement for Bids will be returned to Bidder <br /> unopened. <br /> B. Amendments to submitted Bids will be permitted when received in writing prior to Bid closing and when <br /> endorsed by the same party or parties who signed and sealed the Bid. <br /> C. A Bid may be revised and resubmitted as the official Bid if the City receives the revised bid before the <br /> scheduled time for opening Bids. <br /> 1. Resubmitted Bids shall be in full compliance with these Instructions to Bidders. <br /> 2. Bid security shall be in an amount sufficient for the Bid as resubmitted. <br /> D. Bidders may withdraw their Bid by written request before the scheduled time for opening Bids. <br /> E. After the scheduled time for opening Bids, no Bidder will be permitted to withdraw his Bid unless the <br /> Award of Contract is delayed for a period exceeding 45 calendar days. <br /> 1.2 BID WITHDRAWAL DUE TO ERROR <br /> A. Within five days after the opening of Bids, a Bidder who wishes to claim error after the Bids have been <br /> opened and tabulated shall submit a notarized affidavit signed by the Bidder, accompanied by original <br /> work sheets used in the preparation of the Bid,requesting relief from the responsibilities of award. <br /> I1. Provide affidavit describing the specific error(s) and certify that the work sheets are the originals <br /> used in the preparation of the Bid. <br /> 2. City staff will review the certified work sheets to determine the validity of the claimed error and <br /> I <br /> 3. make a recommendation. <br /> If the City concurs in the claim of error, the Bidder will be relieved of responsibility, and the bid <br /> security of the Bidder will be returned. <br /> 4. Thereafter, at the discretion of the City, all Bids may be rejected or award made to next lowest and <br /> responsive Bidder. <br /> 5. At the discretion of the City, Bidders claiming error may or may not be allowed to participate in <br /> the re-bid. <br /> 1.3 WORK IDENTIFIED IN CONTRACT DOCUMENTS <br /> A. Work required is indicated on the project drawings and described in further detail in Section 01 11 00— <br /> Summary of Work. <br /> B.
