Full compliance by the Contractor with the provisions of this section is a contractual condition precedent to <br /> the Contractor's right to sue or seek any recovery against the Owner in any legal proceeding. <br /> B. CONTENTS I <br /> A. All Contract Claims filed by the Contractor shall be in writing, verified under penalty of perjury by an <br /> officer or principal of the Contractor, and in sufficient detail to enable the Owner's Representative to <br /> ascertain the basis and amount of the Contract Claim. All Contract Claims shall be submitted to the <br /> Owner's Representative. At a minimum, each Contract Claim must include: <br /> 1. A detailed factual statement of the Contract Claim for additional compensation and extension of <br /> Contract Time, if any, providing all necessary dates, locations, and items of work affected by the <br /> Contract Claim. <br /> 2. The dates of all facts related to the Contract Claim. I <br /> 3. The name of each Owner's individual, official, or employee involved in or knowledgeable about the <br /> Contract Claim. <br /> 4. The specific provisions of the Contract that support the Contract Claim and a statement of the reasons <br /> why such provisions support the Contract Claim. <br /> 5. If the Contract Claim relates to a decision of the Owner's Representative that the Contract leaves to <br /> the Owner's Representative's discretion or as to which the Contract provides that the Owner <br /> Representative's decision is final,the Contractor shall set out in detail all facts supporting its position <br /> relating to the decision of the Owner's Representative. <br /> 6. Identification of any documents and the substance of any oral communications that support the <br /> Contract Claim. <br /> 7. Copies of any identified documents that support the Contract Claim, other than Owner documents and <br /> documents previously furnished to the Owner by the Contractor. Standard industry manuals may be <br /> incorporated by reference. <br /> 8. If Contractor seeks an extension of Contract Time: <br /> a. The specific amount of time(including days and dates)sought. <br /> b. The specific reasons the Contractor believes an extension of Contract Time should be granted, <br /> including, but not limited to, compliance with the requirements of 5.2.C. Extensions of <br /> Contract Time;and <br /> c. The specific provisions of the Contract Documents under which it is sought. <br /> 9. If additional compensation is sought, the exact amount sought and a breakdown of that amount into <br /> the following categories: <br /> a. Labor <br /> b. Materials <br /> c. Direct Equipment. The actual cost for each piece of equipment for which a Contract Claim is <br /> made or in the absence of actual cost, the rates established by the AGC/WSDOT Equipment <br /> Rental Agreement that was in effect when the work was performed. In no case shall the amounts <br /> sought or paid for each piece of equipment exceed the rates established by the Equipment Rental <br /> Agreement even if the actual cost for such equipment is higher. The Owner may audit the <br /> Contractor's cost records to determine actual equipment cost.
