I <br /> 1 I <br /> 2 DBE Abbreviations and Definitions <br /> 3 Broker—A business firm that provides a bona fide service, such as professional, <br /> I <br /> 4 technical, consultant or managerial services and assistance in the procurement of <br /> 5 essential personnel, facilities, equipment, materials, or supplies required for the <br /> 6 performance of the Contract, or, persons/companies who arrange or expedite <br /> 7 transactions. <br /> 8 <br /> 9 Certified Business Description — Specific descriptions of work the DBE is I 10 certified to perform, as identified in the Certified Firm Directory, under the Vendor <br /> 11 Information page. <br /> 12 1 13 Certified Firm Directory—A database of all Minority, Women, and <br /> 14 Disadvantaged Business Enterprises. The on-line Directory is available to <br /> 15 Contractors for their use in identifying and soliciting interest from DBE firms. The <br /> 16 database is located under the Firm Certification section of the Diversity <br /> 17 Management and Compliance System web page at: <br /> 18 https://omwbe.diversitycompliance.com. <br /> 19 1 20 Commercially Useful Function (CUE) <br /> 21 49 CFR 26.55(c)(1) defines commercially useful function as: "A DBE performs a <br /> 22 commercially useful function when it is responsible for execution of the work of the <br /> 111 <br /> 23 contract and is carrying out its responsibilities by actually performing, managing, <br /> 24 and supervising the work involved. To perform a commercially useful function, the <br /> 25 DBE must also be responsible, with respect to materials and supplies used on the <br /> 26 contract, for negotiating price, determining quality and quantity, ordering the <br /> 27 material, and installing (where applicable) and paying for the material itself. To <br /> 28 determine whether a DBE is performing a commercially useful function, you must <br /> 29 evaluate the amount of work subcontracted, industry practices, whether the <br /> 30 amount the firm is to be paid under the contract is commensurate with the work it <br /> 31 is actually performing and the DBE credit claimed for its performance of the work, <br /> 32 and other relevant factors." I <br /> 33 <br /> 34 Contract— For this Special Provision only, this definition supplements Section 1- <br /> 35 01.3. 49 CFR 26.5 defines contract as: "... a legally binding relationship obligating <br /> 36 a seller to furnish supplies or services (including, but not limited to, construction <br /> 37 and professional services) and the buyer to pay for them. For purposes of this <br /> 38 part, a lease is considered to be a contract." <br /> 39 iiii <br /> 40 Disadvantaged Business Enterprise (DBE)—A business firm certified by the <br /> 41 Washington State Office of Minority and Women's Business Enterprises, as I 42 meeting the criteria outlined in 49 CFR 26 regarding DBE certification. A <br /> 43 Underutilized Disadvantaged Business Enterprise (UDBE)firm is a subset of DBE. <br /> 44 <br /> 45 Force Account Work—Work measured and paid in accordance with Section 1- <br /> 46 09.6. <br /> 47 <br /> 48 Manufacturer(DBE) —A DBE firm that operates or maintains a factory orI <br /> 49 establishment that produces on the premises the materials, supplies, articles, or <br /> 50 equipment required under the Contract.
