1 <br /> I1 finished goods or products from raw or unfinished material or purchase and <br /> 2 substantially alters goods and materials to make them suitable for construction <br /> I3 use before reselling them. <br /> 4 <br /> 5 Regular Dealer(DBE) —A DBE firm that owns, operates, or maintains a store, <br /> 6 warehouse, or other establishment in which the materials or supplies required for <br /> 7 the performance of a Contract are bought, kept in stock, and regularly sold to the <br /> 8 public in the usual course of business. To be a Regular Dealer, the DBE firm must <br /> 9 be an established regular business that engages in as its principal business and in <br /> I10 its own name the purchase and sale of the products in question. A Regular Dealer <br /> 11 in such items as steel, cement, gravel, stone, and petroleum products need not <br /> 12 own, operate or maintain a place of business if it both owns and operates <br /> I13 distribution equipment for the products.Any supplementing of regular dealers' own <br /> 14 distribution equipment shall be by long-term formal lease agreements and not on <br /> 15 an ad-hoc basis. Brokers, packagers, manufacturers' representatives, or other <br /> I16 persons who arrange or expedite transactions shall not be regarded as Regular <br /> 17 Dealers within the meaning of this definition. <br /> 18 <br /> I19 DBE Goals <br /> 20 No DBE goals have been assigned as part of this Contract. <br /> 21 <br /> I22 Affirmative Efforts to Solicit DBE Participation <br /> 23 The Contractor shall not discriminate on the grounds of race, color, sex, national origin, <br /> 24 age, or disability in the selection and retention of subcontractors, including procurement <br /> 25 of materials and leases of equipment. DBE firms shall have an equal opportunity to <br /> I26 compete for subcontracts in which the Contractor enters into pursuant to this Contract. <br /> 27 <br /> 28 Contractors are encouraged to: <br /> 1 29 <br /> 30 1. Advertise opportunities for Subcontractors or suppliers in a timely and <br /> 31 reasonably designed manner to provide notice of the opportunity to DBEs <br /> I32 capable of performing the Work.All advertisements should include a Contract <br /> 33 Provision encouraging participation by DBE firms. This may be accomplished <br /> 34 through general advertisements (e.g. newspapers, journals, etc.) or by <br /> I35 soliciting Bids/Proposals directly from DBEs. <br /> 36 <br /> 37 2. Establish delivery schedules that encourage participation by DBEs and other <br /> I38 small businesses. <br /> 39 <br /> 40 3.
