I <br /> 111 1 The Builders Risk insurance shall be maintained until final acceptance of the Work by the <br /> 2 Contracting Agency. <br /> I 3 <br /> 4 The Contractor and the Contracting Agency waive all rights against each other and any of their <br /> 5 Subcontractors of every tier, agents, and employees, officers, and officials, for damages caused <br /> I 6 by fire or other perils to the extent covered by Builder's Risk insurance or other property <br /> 7 insurance applicable to the work. The policies shall provide such waivers by endorsement. <br /> 8 <br /> I9 <br /> 10 1-07.18(5)J Pollution Liability <br /> 11 (January 4, 2016 APWA GSP) <br /> 12 <br /> I13 The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for <br /> 14 claims involving bodily injury, property damage (including loss of use of tangible property that <br /> 15 has not been physically injured), cleanup costs, remediation, disposal or other handling of <br /> I16 pollutants, including costs and expenses incurred in the investigation, defense, or settlement of <br /> 17 claims, arising out of any one or more of the following: <br /> 18 <br /> I19 1. Contractor's operations related to this project. <br /> 20 2. Remediation, abatement, repair, maintenance or other work with lead-based paint or <br /> 21 materials containing asbestos. <br /> I22 3. Transportation of hazardous materials away from any site related to this project. <br /> 23 <br /> 24 All entities listed under 1-07.18(2) of these Special Provisions shall be named by endorsement <br /> i25 as additional insureds on the Contractors Pollution Liability insurance policy. <br /> 26 <br /> 27 Such Pollution Liability policy shall provide the following minimum limits: <br /> 28 $$2,000,000$$ each loss and annual aggregate <br /> I29 <br /> 30 1-07.18(5)K Professional Liability <br /> 31 (January 4, 2016 APWA GSP) <br /> 1 32 <br /> 33 The Contractor and/or its Subcontractor(s) and/or its design consultant providing construction <br /> 34 management, value engineering, or any other design-related non-construction professional <br /> 35 services shall provide evidence of Professional Liability insurance covering professional errors <br /> 36 and omissions. <br /> 37 <br /> I 38 Such policy shall provide the following minimum limits: <br /> 39 $1,000,000 per claim and annual aggregate <br /> 1 II <br /> 40 <br /> I41 If the scope of such design-related professional services includes work related to pollution <br /> 42 conditions, the Professional Liability insurance shall include coverage for Environmental <br /> 43 Professional Liability. <br /> I 44 <br /> 45 If insurance is on a claims made form, its retroactive date, and that of all subsequent renewals, <br /> 46 shall be no later than the effective date of this Contract. <br /> I <br /> IWEST MARINE VIEW DRIVE UTILITIES PAGE 54 OF 117 August 2018 <br /> WORK ORDER#3588 <br /> SPECIAL PROVISIONS <br /> i <br />
