I 111 1 The Builders Risk insurance shall be maintained until final acceptance of the Work by the 2 Contracting Agency. I 3 4 The Contractor and the Contracting Agency waive all rights against each other and any of their 5 Subcontractors of every tier, agents, and employees, officers, and officials, for damages caused I 6 by fire or other perils to the extent covered by Builder's Risk insurance or other property 7 insurance applicable to the work. The policies shall provide such waivers by endorsement. 8 I9 10 1-07.18(5)J Pollution Liability 11 (January 4, 2016 APWA GSP) 12 I13 The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for 14 claims involving bodily injury, property damage (including loss of use of tangible property that 15 has not been physically injured), cleanup costs, remediation, disposal or other handling of I16 pollutants, including costs and expenses incurred in the investigation, defense, or settlement of 17 claims, arising out of any one or more of the following: 18 I19 1. Contractor's operations related to this project. 20 2. Remediation, abatement, repair, maintenance or other work with lead-based paint or 21 materials containing asbestos. I22 3. Transportation of hazardous materials away from any site related to this project. 23 24 All entities listed under 1-07.18(2) of these Special Provisions shall be named by endorsement i25 as additional insureds on the Contractors Pollution Liability insurance policy. 26 27 Such Pollution Liability policy shall provide the following minimum limits: 28 $$2,000,000$$ each loss and annual aggregate I29 30 1-07.18(5)K Professional Liability 31 (January 4, 2016 APWA GSP) 1 32 33 The Contractor and/or its Subcontractor(s) and/or its design consultant providing construction 34 management, value engineering, or any other design-related non-construction professional 35 services shall provide evidence of Professional Liability insurance covering professional errors 36 and omissions. 37 I 38 Such policy shall provide the following minimum limits: 39 $1,000,000 per claim and annual aggregate 1 II 40 I41 If the scope of such design-related professional services includes work related to pollution 42 conditions, the Professional Liability insurance shall include coverage for Environmental 43 Professional Liability. I 44 45 If insurance is on a claims made form, its retroactive date, and that of all subsequent renewals, 46 shall be no later than the effective date of this Contract.
