i1 TheP rocedures for determining the quality level and pay factors for a material, other <br /> 2 than HMA compaction, are as follows: <br /> I 3 <br /> 4 1-07.AP1 <br /> 5 Section 1-07, Legal Relations and Responsibilities to the Public <br /> 1 6 April 2, 2018 <br /> 7 1-07.5 Environmental Regulations <br /> I 8 This section is supplemented with the following new subsections: <br /> 9 <br /> 10 1-07.5(5) U.S. Army Corps of Engineers <br /> 11 When temporary fills are permitted, the Contractor shall remove fills in their entirety and <br /> 12 the affected areas returned to pre-construction elevations. <br /> 13 <br /> I 14 If a U.S. Army Corps of Engineers permit is noted in Section 1-07.6 of the Special <br /> 15 Provisions, the Contractor shall retain a copy of the permit or the verification letter (in <br /> 16 the case of a Nationwide Permit) on the worksite for the life of the Contract. The <br /> 17 Contractor shall provide copies of the permit or verification letter to all subcontractors <br /> 18 involved with the authorized work prior to their commencement of any work in waters of <br /> 19 the U.S. <br /> 20 <br /> 1 21 1-07.5(6) U.S. Fish/Wildlife Services and National Marine Fisheries Service <br /> 22 The Contracting Agency will provide fish exclusion and handling services if the Work <br /> 23 dictates. However, if the Contractor discovers any fish stranded by the project and a <br /> I 24 Contracting Agency biologist is not available, they shall immediately release the fish into <br /> 25 a flowing stream or open water. <br /> 26 <br /> I 27 1-07.5(1) General <br /> 28 The first sentence is deleted and replaced with the following: <br /> 29 <br /> I 30 No Work shall occur within areas under the jurisdiction of resource agencies unless <br /> 31 authorized in the Contract. <br /> 32 <br /> I 33 The third paragraph is deleted. <br /> 34 <br /> 35 1-07.5(2) State Department of Fish and Wildlife <br /> I 36 This section is revised to read: <br /> 37 <br /> 38 In doing the Work, the Contractor shall: <br /> 39 <br /> 1 40 1. Not degrade water in a way that would harm fish, wildlife, or their habitat. <br /> 41 <br /> 42 2. Not place materials below or remove them from the ordinary high water line <br /> I 43 except as may be specified in the Contract. <br /> 44 <br /> 45 3. Not allow equipment to enter waters of the State except as specified in the <br /> I 46 Contract. <br /> 47 <br /> 48 4.
