INTERWEST
CONSTRUCTION
INC.
August 21St, 2018 Serial Letter 028
Ken Kettel, Resident Engineer
KBA/City of Everett
3101 Cedar Street
Everett, WA 98201
RE: Notice of Force Majeure Delay: Labor Strike by International Union of Operating
Engineers Local 302
Grand Ave Pedestrian Bridge/PW 3588
Dear Ken:
After close of business last night, Monday August 20th, 2018, the International Union of
Operating Engineers (IUOE) Local 302 voted on and rejected a labor agreement triggering a
strike effective at 6:00 A.M. this morning. With very few exceptions, the equipment operators
and some supporting trades will be striking at all union labor projects in Western Washington.
As of this time, there is not a new agreement under consideration by the IUOE Local 302
although negotiations between the Associated General Contractors (AGC) of Washington and the
IUOE Local 302 are ongoing.
Interwest is working diligently to ascertain the full impact of this developing situation on our
projects and identify avenues to productively progress the work. Without the IUOE Local 302
members to operate heavy equipment, nearly all work will eventually halt if the strike persists.
As the strike is occurring in prime construction season, it likely will not be possible to recover
schedule day-for-day when work resumes due to restricted daylight and degraded weather.
In accordance with Specification 1-08.8, Interwest provides this letter as a preliminary notice and
request for time extension. Due to the uncertain duration and effects of this strike, it is not
possible to quantify the impacts to the Project at this time. Interwest will provide supplemental
notice as required by the Contract when the nature of the impacts has been accurately assessed or
can be reasonably estimated.
Please do not hesitate to contact me if you have questions or wish to discuss this further.
Respectfully,
INTERWEST CONSTRUCTION, INC.
Izaak Fox, P.E.
Project Manager
Cc: Project File
Enclosure:
609 N.Hill Blvd.I Burlington,WA 98233
www.interwest.biz
Ph: (360)757-7574 Fax:(360)757-7574
Contractor License INTERCI121 OF
1 of 1
