Jurisdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br />hold a hearing and to issue the decision. That authorify is sef forth in EMC 15.16.100. <br />Based on the above Findings of Fact, the Hearing Examiner enters the following <br />Conclusions: <br />CONCLUSIONS <br />The Applicant requested approval of a Special Property Use Permit for the <br />installation of three eight-foot high panel antennas to be flush mounted to an <br />existing communication tower/flag pole on property located at 220 Olympic <br />Boulevard, Everett, Washington (subject property). The proposal also includes <br />an equipment cabinet that would have dimensions of 7 feet x 17 feet. (finding 1) <br />2. The proposed project requires a Special Property Use Permit because it is <br />located in a B-2 zone and is within 300 feet �f a residential zone, and 200 feet of <br />a gateway corridor. (findings 1, 2, & 19) <br />3. In order for a Special Property Use Permit to be granted, the General Evaluation <br />criteria as set forth in EMC 19.41.150.0 must be satisfied. These criteria are <br />identified in finding ti.5. The manner in which each of these criteria is satisfied is <br />set forth in findinas #6 through #15. <br />4. In addition to the General Evaluation criteria, the Specific Evaluation criteria of <br />EMC 19.41.150.D.1.b must be satisfied. Thesa criteria are identified in finding <br />#16. The manner in which each of these criteria is satisfied is set forth in findings <br />#17 through #26. <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions and testimony and <br />evidence submitted at the public hearing, it is hereby ordered that the requested Speaal <br />Property Use Permit for the installation of lhree eight-foot panel antennas to be flush <br />mounted to an exisling communication tower/flag pole at 220 Olympic Boulevard, <br />Everelt, Washington, is granted. In addition to the antennas, the Applicant is also <br />permitted to develop a 7 foot x 17 foot equipment cabinet. This Special Property Use <br />Permit is granted subject to the following conditions: <br />All equipment cabinets must be visually screened. After the cabinet is installed, <br />the Applicant shall provide the City with a noise study. If the study shows noise <br />from the site exceeds City standards, the Applicant shall provide an acoustical <br />shield on-site. If the noise from the site doe�s not exceed City standards, no <br />shield shall be required. <br />A building permit is required for ihe antenna installation. <br />7i<` <br />
