PRODUCTS AND SUBSTITUTIONS <br /> 016300 - 5 <br /> 3. Non-Proprietary Specification Requirements: Where the specifications name <br /> products or manufacturers that are available and may be incorporated in the <br /> Work,but do not restrict the Contractor to the use of these products only, the <br /> Contractor may, at his option,use any available product that complies with <br /> contract requirements. <br /> 4. Descriptive Specification Requirements: Where the specifications describe a <br /> product or assembly generically, in detail, listing the exact characteristics <br /> required,but without use of a brand or trade name,provide products or <br /> assemblies that provide the characteristics indicated and otherwise comply <br /> with contract requirements. <br /> 5. Performance Specification Requirements: Where the specifications require <br /> compliance with indicated performance requirements, provide products that <br /> comply with the specific performance requirements indicated, and that are <br /> recommended by the manufacturer for the application indicated. The <br /> manufacturer's recommendations may be contained in published product <br /> literature, or by the manufacturer's individual certification of performance. <br /> General overall performance of a product is implied where the product is <br /> specified for specific performance. <br /> 6. Compliance with Standards, Codes and Regulations: Where the <br /> specifications require only compliance with an imposed standard, code or <br /> regulation, the Contractor has the option of selecting a product that complies <br /> with specification requirements, including the standards, codes and <br /> regulations. <br /> 7. Visual Matching: Where matching an established sample is required, the <br /> final judgment of whether a product proposed by the Contractor matches the <br /> sample satisfactorily will be determined by the Architect. Where there is no <br /> product available within the specified product category that matches the <br /> sample satisfactorily and also complies with other specified requirements, <br /> comply with the provisions of the contract documents concerning <br /> "substitutions" and "change orders" for the selection of a matching product in <br /> another product category, or for non-compliance with specified requirements. <br /> 8. Visual Selection: Except as otherwise indicated, where specified product <br /> requirements include the phrase "... as selected from the manufacturer's <br /> standard colors,patterns,textures..." or similar phrases, the Contractor has the <br /> option of selecting the product and manufacturer,provided the selection <br /> complies with other specified requirements. The Architect is subsequently <br /> responsible for selecting the color,pattern and texture from the product line <br /> selected by the Contractor. <br /> I <br /> 02/19/13 <br />
