• <br /> PRODUCTS AND SUBSTITUTIONS <br /> 016300 - 7 <br /> 9. WARRANTIES (GUARANTEES) <br /> 9.1. Categories of warranties required for the work include: 1) Special project warranty <br /> issued by Contractor and, where required, countersigned by Installer or other <br /> recognized entity involved in performance of the work; 2) Specified product <br /> warranty issued by a manufacturer or fabricator, for compliance with requirements in <br /> contract documents; and 3) Coincidental product warranty available on a product <br /> incorporated into the work,by virtue of manufacturer's publication of warranty <br /> without regard for application requirements (non-specified warranty). Refer to <br /> sections of Divisions 2 through 16 for requirements of specified warranties. <br /> 9.2. Warranty Obligations: Restore or remove-and-replace warranted work to its <br /> originally specified condition, at such time during warranty as it does not comply <br /> with or fulfill terms of warranty. Restore or remove-and-replace other work, which <br /> has been damaged by failure of warranted work or which must be removed and <br /> replaced to gain access to warranted work. Except as otherwise indicated or required <br /> by governing regulations, warranties do not cover consequential damages to property <br /> other than work of the Contract, (e.g.,building contents). Cost of restoration or <br /> removal-and-replacement is Contractor's obligation,without regard to whether <br /> Owner has already benefited from use of failing work. <br /> 9.3. Reinstatement of Warranty: Upon restoration or removal-and-replacement of <br /> warranted work which has failed,reinstate the warranty by issuing newly executed <br /> form, for at least the remaining period of time of the original warranty,but for not <br /> less than half of the original warranty period. <br /> 9.4. Owner's Recourse: Warranties and warranty periods do not diminish implied <br /> warranties, and do not deprive Owner of actions, rights and remedies otherwise <br /> available for Contractor's failure to fulfill requirements of the Contract Documents. <br /> Owner reserves right to reject coincidental product wartanties considered to be <br /> conflicting with or detracting from requirements of the Contract Documents. <br /> End of Section 016300 <br /> 1 <br /> 02/19/13 <br />
