Page 2
Letter to Dan Mathias
September 29, 1997
Second: Without consent of t6e Association, t6e we'v elevativn, es h exisls
todey (September 29, 1997) is exectly what the City insisted. 'HE TOP OF
EXISTINGCRQOKED FIXED IN PLACE CONCRETI: BLQ('K is
now t6e bottom of the outfall we'v (at its lowest point the weir elevation is
eleven ioches belov the top elevation oft6e outfell plate).
Third: Agein, and again!!! the vandaGsm to the outfall included broken,
poured-in-place-concrete that wns 'boaded" to and on ton of the crooked
fixed in plece concrete block. The eastence of the poured concrete on top of
the crooked concrete bluck prevents t6e top of the concrete block from having
been the bottom of the weir. It fiuther heips to verify t6e eccuracy of the
measurements of the lake elevation survey.
The Ci.ry's elevation is wrong, but we submit to your decision. As you well Imow, our
efl'orts all along have been to repa'v the outfall at an elevation approved by the City. As of
today that hes happened. Md, no Curther action of any kind and no further costs will be
incurred by Village by the Lake Association to chege the elevation you established and you
directed to occur. Said elevation will permanently reducc the leke elevation three inches
lower than the lake elevation survey.
Last: In a letter to us (distributed to some of our neighbors by you, or Jim Oranne) you
stated that the City has received a number of complaints this last year related to the lake
outfall. Utiliring public disclosure lavs, we made a fortnal request for copies of those verbal
or written complaints. Given that no information has yet been received by us, are we to
conclude that there are no complaint?
Sincer y, ,•
12 _ -
Cec Strong, Associatiun Chair
Village by the Lake Condominium Association
cc: Doerd of Directors
Kris Suncberg, Corpornte Counsel
