You explained that it was up to Villege by
the Lake Associatian to detertnine what the Lake's elevation was prior to the vendalism
Based on your elaoetion, the Association performed a leke elevation survey by `polling'•
individual neighbors at their properties. Those owners were able to show us where the
normal high water elevation of the leke touched the'v walls end propetty. Thai elevation
was precisely measured against that-day's exact water level. As a "fail safe", every retaining
wall was measured to be certain that the recollections of the'v neighbors' did not impact
other propenies by submerging, or by risking subroerging any yap. 7be yvn,ev elevatiun
wes wcll below che to of eve wall includin e OTanne walL which is Pven and
shows lone term signs of sinkinel. The measurements from property to property were
compared to each other as a check nn the accuracy. The result of this survey was a decisive
commonaliry, The exact, survey elevation was transferred to the outside wall of the lake
outfall and measurements were coirelated to the top of the outfall plate. That exact
distance was used to design the repair of the outfall.
Now, After months of your explaining that the City would not provide the elevation of
Beverly Lake, you have provided the elevation. It is our understanding thet you established
this elevation based on the existence of a concrete block t6et sits (fixed in place) at the
bonom of the outfall and that no survey was done to determine the lake elevation. Your
decision was made by exatnining the dry outfall (above the waterline) hypothesiring that the
top of the existing concrete block was the bottam of the fortner we'v. Had the City made
such a detertnination earlier it would not have beei necessary for the Associetion to do the
lake survey. This letter is written for the sole purpose of recording three things:
First: On September 21, 1997, Village by de Lake Associetion repaired the
lake outfall weir to the precise measurements of our lake elevation survey
(0.67 feet below the top of the outfall plate). One week later, at your
insistence. thnt repair was changed.
j
'
