7-16-13 <br /> Council President Moore <br /> City of Everett <br /> 2930 Wetmore Ave. <br /> Everett,WA 98201 <br /> Dear Council President Moore, <br /> I am writing concerning a permit I have requested to replace my existing driveway at 512 <br /> Wetmore Ave. I submitted a permit and was told it was denied. I was then told that I should write <br /> you this letter to appeal this decision. At then end of this letter please find the email I received <br /> which I have based this request on. <br /> - Please consider this letter a request to place this issue of a variance under EMC 13.16.110 <br /> on the Council agenda. <br /> - Brief narrative statement of the situation: We currently own 512 Wetmore Ave. Our home <br /> has an existing driveway from Wetmore to our garage.We are seeking to replace this <br /> driveway with a wider longer driveway moved south on our property and still exiting to <br /> Wetmore. We feel this should be granted because of the following reasons: 1.We are not <br /> adding a driveway to Wetmore, but are just replacing the one we already have.2.This <br /> matches the rest of our block for Wetmore access.3. It would not be possible to put in a <br /> driveway to our alley as our garage access is on the front of our home. <br /> - This request meets the four conditions of EMC 13.16.1 10.A-D as follows: <br /> o A. "The variance requested arises from peculiar physical conditions not ordinarily <br /> existing in similar districts in the city or is due to the nature of the business or operation <br /> upon the applicant's property" . Please see the attached exhibit showing current <br /> access to my garage. Placing access from the alley would not allow me to <br /> access in my current configuration. <br /> o B. "That the variance requested is not against the public interest,particularly safety, <br /> convenience and general welfare;". We currently have our driveway exiting to <br /> Wetmore.Therefore, there would be no change other than the new driveway <br /> apron would be updated to meet current city of Everett standards.This only <br /> benefits the public and increases safety. <br /> o C. "That the granting of the permit for the variance will not adversely affect the rights <br /> of the adjacent property owners or tenants;". We would not be crossing any property <br /> lines with our replacement driveway. I have spoken with my neighbor to the south and <br /> he had no concerns. <br /> o D. "That the terms of this chapter will work unnecessary hardship on the applicant, <br /> property owner or tenant. (Prior code§13.36.110)". The unnecessary hardship is the <br /> same as my comment on item A. If I was forced to install a driveway from the <br /> alley it would require me to spend additional funds to change or replace my <br /> existing garage. <br /> - An exhibit depicting the existing and proposed driveway configurations and showing the <br /> alley at the rear of the property is included for reference.This exhibit also shows our <br /> surrounding neighbors driveways to Wetmore.The only exceptions are the corner lots <br />
