The subject property is on Riverside Road and near the Snohomish River. <br /> The shoreline designation is Urban Industrial and the zoning designation is M- <br /> 2, Heavy Manufacturing. The City of Everett Comprehensive Plan designation <br /> is 5.1, Heavy Industrial. (exhibit 1, staff report, page 1; exhibit 2, JARPA <br /> application; exhibit 4, plan set, page 1) <br /> 3. • Urban Industrial and Urban Mixed-Use Industrial shoreline areas along the <br /> main channel of the Snohomish River upriver from the SR 529 bridge are <br /> located adjacent to a federally maintained navigation channel and may be <br /> commercially viable. These areas are to some degree constrained due to the <br /> restrictions of the SR 529 bridge and the presence of significant environmental <br /> features along certain sections of the river. In these areas, nonwater <br /> dependent and nonwater related uses shall be permitted within 200 feet of the <br /> ordinary high water mark provided such uses provide substantial public access <br /> and public enjoyment of the shoreline. Water dependent and water related <br /> uses shall be prohibited where they would require new dredging, fill, piers, or <br /> other significant modifications in areas designated Aquatic Conservancy. All <br /> nonwater dependent and nonwater related uses shall preserve and enhance <br /> existing native shoreline vegetation per the requirements of EMC 19.37 and <br /> shall provide environmental restoration when feasible. The proposed project was subject to Washington State Environmental Policy <br /> Act (SEPA) review pursuant to RCW 42.21.C. The City of Everett was <br /> designated as the lead authority, and the City's Responsible Official issued a <br /> final Mitigated Determination of Non-Significance (MDNS) for the project on <br /> February 20, 2017. No appeals were filed of the SEPA determination. (exhibit <br /> 1, staff report, page 1; exhibit 6, Final MDNS; testimony of Mr. Jimerson) <br /> 5. Historically, the subject property was part of the Weyerhaeuser Corporation's <br /> operations that existed in north Everett. The site has been vacant since the <br /> demolition of the Weyerhaeuser Mill in the 1990's. Subsequent to the <br /> demolition of the mill and the termination of Weyerhaeuser's use of the <br /> property, the Port of Everett (Port) included the property as part of the <br /> Riverside Business Park which was approved with City of Everett Shoreline <br /> Permit SMA#99-002. The business park included the subject property. Fill <br /> was placed on the site to lift the site out of the 100-year flood plain and a <br /> Letter of Map Revision (LOMR-F) was issued by the Federal Emergency <br /> Management Agency (FEMA).
