27. Binding site plans are subject to review of the Environmentally Sensitive Area <br /> regulations of the Everett Zoning Code, Title 20, EMC. It is also subject to <br /> SEPA review. The environmental standards and regulations have been <br /> considered and the proposal satisfies both reviews. The Final Mitigated <br /> Determination of Non-Significance was issued and no appeals were filed. <br /> There are no wetlands or streams on the subject property. The Snohomish <br /> River is located 50 feet to the east, and the development near the Snohomish <br /> River has been covered in the shoreline permit review. The Biological Assessment that was prepared reached the conclusion that the <br /> project will not:adversely impact or endanger any species or habitats. The <br /> Biological Assessment Report and ESA FEMA Floodplain Analysis were <br /> conducted by Soundview Consultants LLC and included investigation for the <br /> presence of fish and wildlife habitat and ESA listed species. The on-site <br /> portion of the riparian buffer zone does not contain sensitive plant, fish, or <br /> wildlife species, or functional habitat. Other issues were addressed. Public utility services are available to the site. There is water supply that <br /> meets City standards. The City in its review of the transfer has not identified <br /> any deficiencies of the system and noted that water system improvements <br /> must satisfy City standards. (exhibit 1, staff report, page 6; testimony of Mr. <br /> Jimerson) <br /> 30. The sewage conveyance system for the site is currently owned by the Port of <br /> Everett. In addition, there is a treatment plant serving this site that is owned <br /> by the City of Everett. Negotiations for the transfer of the conveyance system <br /> to the City are on-going. The City Utility Department reviewed the proposal <br /> and has not identified deficiencies in the conveyance system of the treatment <br /> plant. However, they have noted that the sewer system must meet City <br /> standards, and the current system may have to be improved. A preliminary storm drainage report was submitted with the application. The <br /> City Stormwater Engineer reviewed the materials and noted the project will be <br /> reviewed pursuant to the 2014 Stormwater Management Manual which <br /> became effective January 1, 2017. A detailed stormwater design is required at <br /> the time of construction plan submittal for compliance purposes with the <br /> current City stormwater standards.
