I <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> 11 the project manager and superintendent and allow timely completion of the Project. <br /> The project manager and superintendent shall be approved by the City, and such <br /> I approval shall not be unreasonably withheld. Contractor shall submit personnel <br /> qualifications within seven (7) days of Contractor's execution of the Contract. Basis for <br /> disapproval include, but are not limited to, lack of sufficient experience managing the <br /> I construction of similar type or size projects or relationships on other projects <br /> unsatisfactory to the City or, if the Project is subject to supplemental bidder <br /> responsibility criteria and such criteria contain personnel qualifications, the personnel <br /> differ from those named by Bidder in its pre-Award supplemental bidder responsibility <br /> Icriteria submittals. City may require removal and replacement of Contractor's <br /> supervisory staff who are disruptive or who appear to lack sufficient competence to <br /> complete the Project successfully. <br /> I1-05.18(2) Construction Procedures <br /> The Contractor shall supervise and direct the Work and determine the means, <br /> methods, techniques, sequences and procedures of construction, except in those <br /> Iinstances where the City, to define the quality of an item of Work, specifies in the <br /> Contract a means, method, technique, sequence or procedure for construction of that <br /> item of Work. The Contractor shall execute Work in conformity with the standard <br /> Ipractice of the trade. <br /> 1-05.18(3) Responsibilities <br /> I 1-05.18(3)A Manufacturers and Suppliers <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br /> manufacturers, Suppliers and their employees. <br /> I 1-05.18(3)B Contractor's Employees <br /> The Contractor shall be responsible for the adequacy, efficiency and sufficiency of <br /> its employees. Workers shall have sufficient knowledge, skill and experience to <br /> I perform properly the Work assigned to them. <br /> 1-05.18(3)C Payment for Labor and Materials <br /> The Contractor shall pay and require its Subcontractors to pay any and all <br /> I accounts for labor including Worker's Compensation premiums, State <br /> Unemployment and Federal Social Security payments and other wage and salary <br /> deductions required by law. The Contractor also shall pay and cause its <br /> I Subcontractors to pay any and all accounts for services, equipment, and materials <br /> used by him and its Subcontractors during the performance of Work under this <br /> Contract. The Contractor shall pay such accounts as they become due and <br /> I payable. If requested by the City, the Contractor shall promptly furnish proof of <br /> payment of such accounts to the City. <br /> 1-05.18(3)D Attention to Work <br /> I The Contractor, either in person or acting through its representative, shall give <br /> personal attention to and shall manage the Work so that it shall be prosecuted <br /> faithfully and completed under the Project schedule. When its representative is <br /> I not personally present at the Project site, its designated alternate shall be <br /> available and shall have the authority to act in matters relating to this Contract. <br /> Where detailed construction requirements are not set forth in the Standard <br /> I Specifications or these Special Provisions, the Contractor shall perform the Work <br /> of a quality comparable to the workmanship specified for other parts of the Work, <br /> from firms having established good reputations for similar Work, or by following <br /> Iindustry standard practices.
