• <br /> the Everett Municipal Code that is enforceable under this chapter, regardless of <br /> location. <br /> Conclusions of Law Based on Above Findings: <br /> 1. The modification of the structure at 7533 Lower Ridge Road, Everett, Washington <br /> including the installation of mechanical systems and electrical wiring without a <br /> permit issued from the City of Everett is in violation of IRC 105.1 as adopted by <br /> EMC 16.01.040.Q. Permits for conducting such work are required per the code <br /> prior to conducting any work. <br /> 2. The occupancy of a building without a valid certificate of occupancy is a violation of <br /> IRC 110.1. A valid certificate of occupancy is required prior to any occupancy of a <br /> rental. <br /> 3. The occupancy of an unlawful building is a violation of IPMC 108.1.4. The <br /> occupancy of an illegally altered dwelling is specifically prohibited by this ordinance. <br /> 4. On April 11, 2011, the Examiner found that the Respondent previously violated IRC <br /> 105.1. The Respondent is a repeat violator because he violated the same sections <br /> of EMC within the past twenty-four months. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 1. The Respondent shall abate all violations of IRC Sections 105.1 as adopted by <br /> EMC 16.01.040.0, IRC110.1 and IPMC 108.1.4 located at the property at 7533 <br /> Lower Ridge Road, Everett, Washington. <br /> 2. All abatement of the violations on the above mentioned property shall be completed <br /> by October 12, 2012, abatement shall include: <br /> a. The Respondent shall remove any and all occupants of the structure and shall <br /> keep it vacant until such time that a valid certificate of occupancy is issued by <br /> the City of Everett. The removal of the tenants shall be in full compliance with <br /> all provisions of the Washington State Landlord-Tenant Act, RCW 59.18. <br /> b. The Respondent is required to apply for and obtain all of the required permits to <br /> restore the property back to a single-family residence. The Respondent shall <br /> then conduct and complete all of the work required under those permits and <br /> shall have the work inspected and approved by the City of Everett Building <br /> Department. <br /> 3. The Respondent shall pay$1,000.00 for each violation of IRC Sections 105.1 as <br /> adopted by EMC 16.01.040.Q and 110.1 and IPMC 108.1.4 because the <br /> 'SM <br />
