10. The Respondent was given the opportunity to correct the conditions and received <br /> adequate notice to appear at this hearing to contest the City's findings. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any EMC provision that identifies Chapter 1.20 EMC <br /> for enforcement, the Violations Hearing Examiner of the City of Everett has jurisdictional <br /> authority to hold this hearing and to issue the decision. EMC §1.20.020 <br /> Applicable Law: <br /> 1. International Residential Code 2009 105.1 as adopted by EMC 16.01.040.Q, <br /> Permits required which reads; <br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br /> move, demolish or change the occupancy of a building or structure, or to erect, <br /> install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br /> mechanical or plumbing system, the installation of which is regulated by this code, <br /> or cause any such work to be done, shall first make application to the building <br /> official and obtain the required permit. <br /> 2. International Residential Code 2009 110.1 which reads; <br /> No building or structure shall be used or occupied and no change in the existing <br /> occupancy classification of a building or structure or portion thereof shall be made <br /> until the building official has issued a certificate of occupancy therefore as provided <br /> herein. Issuance of a certificate of occupancy shall not be construed as an approval <br /> of a violation of the provisions of this code or of other ordinances of the jurisdiction. <br /> Certificates presuming to give authority to violate or cancel the provisions of this <br /> code or other ordinances of the jurisdiction shall not be valid. <br /> 3. International Property Maintenance Code 108.1.4 which reads; <br /> An unlawful structure is one found in whole or in part to be occupied by more <br /> persons than permitted under this code, or was erected, altered or occupied <br /> contrary to law. <br /> 4. Everett Municipal Code §1.20.010(E)which reads; <br /> "Repeat violator"means any person, firm, corporation, association, or agent thereof <br /> who has had any order issued pursuant to the provisions in this chapter, including <br /> any order issued subsequent to a hearing, any stipulated order and any default <br /> order, and within twenty-four months of the issuance of such order commits or <br /> allows to'be committed a new and separate violation of a same or similar chapter of <br /> 4 <br />
