On May 15,2017,a notice to comply was sent via first class mail to the Respondent <br /> informing him of conditions observed on the subject property that were in violation of City <br /> ordinances. The notice provided a corrective action date of November 13,2017 to abate the <br /> violations. (Exhibit#10, Notice to Comply, dated May 15, 2017) (Testimony of Code <br /> Enforcement Officer Cunningham) <br /> 14. On November 14,2017,Cindy Bergsma,City of Everett Permit Technician,informed <br /> Officer Cunningham that on May 15,2017,the Respondent had requested an extension of <br /> the expiration date for permit#BW1604-002 to November 11,2017. The request was <br /> accepted and the expiration date of permit#BW 1604-002 was extended to November 11, <br /> 2017. The Respondent had not scheduled any required building division inspections and <br /> permit#BW1604-002 was expired. On November 14,2017, Officer Cunningham reinspected the subject property and observed <br /> and photographed that the southeast corner of the residential structure remained covered <br /> with tarps and that the exterior surface of the detached garage and residential structures had <br /> not been painted. On November 15,2017,the City issued a violation citation to the Respondent for violations <br /> of: International Property Maintenance Code(IPMC)304.2 Protective Treatment as adopted <br /> by EMC 16.005.010 and IPMC 304.6 Exterior Walls as adopted by EMC 16.005.010. 1 <br /> Copies of the violation citation were mailed via first class and certified mail to the <br /> Respondent's last known address,which Officer Cunningham obtained from Snohomish <br /> County Assessor's record. A copy of the violation citation was posted on the subject <br /> property on November 16,2017. Each method of service used is independently sufficient to <br /> provide notice pursuant to EMC 1.20.010.C.1. Upon research of City permit records on November 30,2017, Officer Cunningham 1 <br /> determined that the Respondent had not applied for or obtained the required City permits to <br /> bring the residential structure into compliance with City ordinances. Respondent Raulston testified at the hearing that due to unforeseen costs associated with <br /> structural repair on the residential structure,he did not have the funds to make exterior <br /> repairs. On December 5,2017,the City Building Division granted an extension to permit <br /> #B W 1604-002 giving another expiration date of June 4,2018.
