CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to EMC Chapter 1.20 or any Everett Municipal Code provisions that identify EMC <br /> Chapter 1.20 for enforcement,the Violations Hearing Examiner of the City of Everett has <br /> jurisdictional authority to hold this hearing and to issue the decision. EMC 1.20.020. <br /> Applicable Law: <br /> 1. IPMC 304.2 Protective Treatments,which reads: <br /> Exterior surfaces, including but not limited to, doors, door and window frames, cornices, <br /> porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior <br /> wood surfaces, other than decay-resistant woods, shall be protected from the elements and <br /> decay by painting or other protective covering or treatment. Peeling,flaking and chipped <br /> paint shall be eliminated and surfaces repainted. Siding and masonry joints, as well as those <br /> between the building envelope and the perimeter of windows, doors and skylights, shall be <br /> maintained weather resistant and water tight. Metal surfaces subject to rust or corrosion <br /> shall be coated to inhibit such rust and corrosion, and surfaces with rust or corrosion shall <br /> be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be <br /> removed from exterior surfaces. Surfaces designed for stabilization by oxidation are exempt <br /> from this requirement. <br /> 2. IPMC 304.6 Exterior Walls,which reads: <br /> Exterior walls shall be free from holes, breaks, and loose or rotting materials;and <br /> maintained weatherproof and properly surface coated where required to prevent <br /> deterioration. <br /> Conclusions of Law Based on Above Findings: <br /> 1. The dilapidated and deteriorated condition of the detached garage and residential structures <br /> on the subject property is a violation of IPMC 304.2 and IPMC 304.6. The record <br /> demonstrates said City ordinance was violated. <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above, it is hereby determined that <br /> the Respondent allowed violation of IPMC 304.2 and IPMC 304.6 on the subject property and is <br /> hereby ordered to: <br /> 1. The Respondent must abate all violations of IPMC 304.2 and IPMC 304.6 on property <br /> located at 1709 Cedar Street,Everett,Washington. <br /> 2. All abatement of the violations on said property must be completed by August 7,2018. <br /> 1 <br /> Abatement shall include: <br /> a. The Respondent shall apply for and obtain all of the necessary and required permits to <br /> bring the detached garage and residential structures on the subject property into <br /> compliance with City ordinances. The Respondent shall have a qualified contractor <br />
