Jason Cihak, Respondent, is the owner of record of the property at 3825 Colby <br /> Avenue, Everett, Washington (property) which is in an R-4 Multiple Family High <br /> Density zone as established by the City of Everett. A Notice of Trustee's Sale was <br /> filed on the property with Snohomish County on February 11, 2016. The property is <br /> scheduled for a foreclosure sale on June 17, 2016. On March 15, 2016, City of Everett Fire Department responded to the property on a <br /> reported fire in the basement of the residential structure on site. City of Everett <br /> Code Enforcement Officer Kevin Fagerstrom conducted in inspection of the property <br /> that same day and observed and photographed fire damaged plumbing and <br /> electrical systems in the basement of the residential structure on site. At the time of <br /> the fire the electrical service to the property had been cut off. On March 23, 2016, during an inspection of the property, Officer Kevin Fagerstrom <br /> observed that a new hot water tank was being delivered to the property for <br /> installation into the residential structure on site. He also observed that an electrical <br /> meter on sight was spinning indicating that electrical service had been restored to <br /> the property. Tony Lee and Barry Pomeroy, City of Everett Building Division, <br /> informed Officer Fagerstrom that City electrical and plumbing permits are required <br /> prior to restoring power and replacing plumbing fixtures to fire damaged structures. <br /> (Exhibit#9, Email from Tony Lee dated March 23, 2016) (Exhibit#10, Email from <br /> Barry Pomeroy dated March 23, 2016) (Testimony of Code Enforcement Officer <br /> Fagerstrom) <br /> 4. On March 24, 2016, the City issued a violation citation to the Respondent for <br /> violations of International Property Maintenance Code (IPMC) 106.1 Unlawful Acts <br /> as adopted by EMC 16.005.010; IPMC 108.1.4 Unlawful Structure as adopted by <br /> EMC 16.005.010; IPMC 504.1 General as adopted by EMC 16.005.010 and IPMC <br /> 604.3.2 Abatement of Electrical Hazards Associated with Fire Exposure as adopted <br /> by EMC 16.005.010. Copies were mailed to the Respondent via first class and <br /> certified mail to the Respondents last known address which Officer Fagerstrom <br /> obtained from Snohomish County Assessors Record.
