Each method of service is independently sufficient to provide notice. <br /> (Pursuant to EMC 1.20.010.C.1) (Exhibit#4, Violation Citation dated March 24, <br /> 2016 with unclaimed mail receipts) (Exhibit#5, Declaration of Service dated March <br /> 24, 2016 with photo) (Testimony of Code Enforcement Officer Fagerstrom) <br /> 5. On March 24, 2016, a Notice of Condemnation was sent to the Respondent via first <br /> class and certified mail which informed the Respondent that the residential structure <br /> on the property was unlawful and must be vacated immediately. The structure was <br /> to remain vacant until occupancy was approved by the City of Everett Building <br /> Division. A condemnation placard was posted on the structure on site. (Exhibit#11, <br /> Notice of Condemnation dated March 24, 2016 with unclaimed mail receipts) <br /> (Exhibit#, Condemnation Placard dated March 24, 2016) (Testimony of Code <br /> Enforcement Officer Fagerstrom) <br /> 6. While posting notices at the property, Officer Fagerstrom observed the residential <br /> structure appeared to be occupied by the presence of two domestic dogs in the <br /> front yard. The presence of the dogs supported a suspicion that the property was <br /> occupied. (Exhibit#2a, Inspection Photos dated March 24, 2016) (Testimony of <br /> Code Enforcement Officer Fagerstrom) s <br /> 7. On March 28, 2016, Ted Budden, City of Everett Building Division Inspector, <br /> informed Officer Fagerstrom that during an inspection of the property it was noted <br /> that the electrical meter was running. Inspector Budden said that Public Utility <br /> District (PUD) would be contacted to request electrical service be disconnected at <br /> the can for the property. The electrical system for the residential structure on the <br /> property has not been inspected by the City or approved for service. (Testimony of <br /> Inspector Budden) (Testimony of Code Enforcement Officer Fagerstrom) <br /> 8. On May 9, 2016, during a reinspection of the property Officer Fagerstrom observed <br /> that the residential structure on site was vacant and electrical service was <br /> disconnected. Upon research of City records, Officer Fagerstrom determined that <br /> the Respondent had not applied for required City permits to restore electrical <br /> service or make repairs to the fire damaged residential structure on site. (Exhibit <br /> #1a-le, Inspection Photos dated May 9, 2016) (Testimony of Code Enforcement <br /> Officer Fagerstrom) <br /> 9. The City provided the Respondent with an opportunity to correct the conditions that <br /> were in violation of sections of the EMC and provided notice of the date, time and <br /> place of this hearing. The Respondent appeared at the hearing but left during <br /> testimony. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br />
