4 f/ <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 120 EMC or any Everett Municipal Code (EMC) provisions that <br /> identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br /> of Everett has jurisdictional authority to hold this hearing and to issue the decision. <br /> EMC §1.20.020 <br /> Applicable Law: <br /> 1. IPMC 108.1.4 Unlawful Structure, which reads: <br /> An unlawful structure is one found in whole or in part to be occupied by more <br /> persons than permitted under this code, or was erected, altered or occupied <br /> contrary to law. <br /> 2. IPMC 106.1 Unlawful Acts, which reads: <br /> It shall be unlawful for a person, firm or corporation to be in conflict with or in <br /> violation of any provisions of this code. <br /> 3. IPMC 504.1 General,which reads: <br /> All plumbing fixtures shall be properly installed and maintained in working order, <br /> and shall be kept free from obstructions, leaks and defects and be capable of <br /> performing the function for which such plumbing fixtures are designed. All plumbing <br /> fixtures shall be maintained in a safe, sanitary and functional condition. <br /> 4. IPMC 604.3.2 Abatement of Electrical Hazards Associated with Fire Exposure, <br /> which reads: <br /> The provisions of this section shall govern the repair and replacement of electrical <br /> systems and equipment that have been exposed to fire. <br /> Conclusions of Law Based on Above Findings: <br /> 1. Fire damaged electrical and plumbing systems in a residential structure renders the <br /> structure as unlawful as defined by IPMC 108.1.4 and is a violation of IPMC 106.1. <br /> The Respondent violated said City ordinance. <br /> 2. The plumbing system in the residential structure on the property damaged by fire <br /> constitutes a hazard to the occupants and is a violation of IPMC 504.1. The <br /> Respondent violated said City ordinance. <br /> 3. The re-energizing of the electrical system in the residential structure on the property <br /> was damaged by fire is a violation of IPMC 604.3.2. The Respondent violated said <br /> City ordinance. <br />
