Structure as adopted by EMC 16.005.010; IBC 105.1 Permits Required as adopted <br /> by EMC 16.005.010 and EMC 8.20.020(A) Nuisances. Copies were mailed to the <br /> Respondent via first class and certified mail to the Respondents last known address <br /> which ECE Officer Fagerstrom obtained from Snohomish County Assessors <br /> Record. A copy was posted at the property. Each method of service is <br /> independently sufficient to provide notice. (Pursuant to EMC 1.20.010.C.1) <br /> 5. On July 30, 2014, a Notice of Condemnation was sent to the Respondent via first <br /> class and certified mail. A copy was posted at the property. <br /> 6. On September 4, 2014, the Respondent applied for and obtained electrical permit <br /> #E1409-019 to restore power to the commercial structure on site. The work was <br /> inspected and approved by Tim Alaniz, City of Everett Electrical Inspector. <br /> 7. On September 19, 2014, ECE Officer Fagerstrom reinspected the property and <br /> observed and photographed that the discarded junk, trash and garbage had been <br /> removed from the rear lot of the property. He also observed that the structure was <br /> vacant and electrical services had been restored to the structure. <br /> 8. The Respondent understands that she had the right to contest the violation citation <br /> at a hearing in which the City bears the burden of proving by clear and convincing <br /> evidence that the violations stated in the citation did occur. The Respondent elects <br /> to forego a hearing and instead enter into this Stipulation. By entering this <br /> stipulation, the Respondent and the City agree that the facts set forth in the violation <br /> citation and in this stipulation are true and accurate and cannot be contested at a <br /> later date in this or any other proceeding. <br /> 9. The violation citation accurately described conditions observed on the property on <br /> July 30, 2014, in that the following conditions were present: <br /> a. The occupied commercial structure was without approved electrical service. <br /> Power was being provided by the use of a portable gasoline electrical <br /> generator. The absence of approved electrical service to an occupied structure <br /> is a violation of IPMC 604.1 and IPMC 601.2 which reads: <br /> Every occupied building shall be provided with an electrical system in <br /> compliance with the requirements of this section and Section 605. <br /> The owner of the structure shall provide and maintain mechanical and electrical <br /> facilities and equipment in compliance with these requirements. A person shall <br /> not occupy as owner-occupant or permit another person to occupy any <br /> premises which does not comply with the requirements of this chapter. <br /> b. The covered porch structure that had been constructed on the rear portion of <br /> the main structure was built without required City permits. This is a violation of <br /> IBC 105.1 which reads: <br /> 2 <br />
