1 <br /> If the Owner has reason to believe that collusion exists among bidders,the Owner will reject the bids of <br /> the known participants in such collusion and may,at its option,require that all bidders certify under <br /> penalty of perjury,that no collusion has occurred or exists. <br /> 1 <br /> 9. RETURN OF BID GUARANTIES <br /> Within 15 calendar days after the bids are opened,the Owner will return the bid guaranties accompanying the <br /> bids which are not to be considered in making the award. All other bid guaranties will be held until the <br /> Contract has been fully executed;after which,they will be returned to the respective bidders whose bids they <br /> accompanied. <br /> 10. AWARD OF CONTRACT <br /> 10.1.EVALUATION OF BIDS <br /> Bids will be evaluated by the Owner to determine which bid if any,should be accepted in the best interest <br /> of the Owner.The Owner,in its sole discretion reserves the right to accept or reject bids submitted and <br /> to waive informalities and minor irregularities "•: e• ••: . - - - - <br /> Al <br /> 1. RESPONSIVENESS: Owner will consider all the material submitted by the bidder to determine <br /> whether his offering is in compliance with the Contract Documents. <br /> 2. RESPONSIBILITY: The Owner will consider all material submitted by the bidder,and other <br /> evidence it may obtain otherwise,to determine whether the bidder is capable of and has a history of <br /> satisfactorily completing Contracts of this type. Such evaluation will include,but not be limited to, <br /> the following factors: (1)whether bidder has adequate financial resources to complete the work;(2) <br /> whether the bidder has the necessary experience and organization to perform the work satisfactorily; <br /> (3)whether the bidder has a satisfactory record of performance,integrity,experience and skills to <br /> perform and complete the work;(4)whether the bidder has a history of completing,failing to <br /> complete,defaulting on,or otherwise not completing construction Contracts;(5)whether the bidder <br /> or its proposed subcontractors have been involved in disputes or litigation with other Owners and <br /> Engineers;and(6)whether the bidder's proposed subcontractors appear capable of and have <br /> histories of satisfactorily completing construction Contracts. <br /> 3. LOWEST: - - __- t!! ! • . .- t.2== .The lowest responsive bid price by a <br /> responsible bidder will be based upon the lump-sum total of the base bid price plus all alternate bid <br /> schedule items(if any). Schedules and items actually awarded to the lowest responsive,responsible <br /> bidder shall be at the Owner's discretion in order to accommodate available funding.Al <br /> 10.2.PRE-AWARD CONFERENCE <br /> After bid opening,but prior to award,the apparent successful bidder shall attend a pre-award conference <br /> to respond to any questions by the Owner regarding evaluation of bids. The Owner will emphasize items <br /> such as insurance and bonding that will assist in prompt issuance of the notice to proceed. By conducting <br /> a pre-award conference,the Owner has not thereby waived its right to make determinations regarding <br /> responsiveness and responsibility of the bidder. <br /> 1 10.3.ACCEPTANCE OF BID <br /> Within 45 days after the opening of bids,the Owner will act either to accept a bid from a responsive, <br /> responsible bidder,or to reject all bids. The Owner reserves the right to request extensions of such bid <br /> acceptance period. The acceptance of a bid will be evidenced by a written notice of award of Contract <br /> delivered in person or by certified mail to the bidder whose bid is accepted,together with a request to <br /> furnish a performance bond and evidence of insurance and to execute the agreement set forth in the <br /> Contract Documents. A contract shall not be formed until the Contract Documents are signed by the <br /> Mayor. <br /> 00100-5 <br />
