Towers associated with above ground utility and communication� facilities and all <br /> ancillary structures shall comply with the setback of the zone in which the propeity is <br /> located. <br /> Findin : No new tower is proposed. <br /> Conclusion: Criterion not applicable to this project. <br /> 8. The above ground utiiity or communication facility shall be removed from the site should <br /> the use for sucli purposes be discontinue� for 120 days of more. <br /> Findin : AT&T will remove the facility if use of the site is discontinued for 120 days or more. <br /> Conclusfon: Applicant has indicated lhey will comply with this requirement. <br /> 9. Maintenance or replacement of existing utility or communications facilities, and the <br /> installation of new utility poles, light poies or standards, switch cabinets, pad mount <br /> transformers or other similar utiiity of communications facilities of a minor naturo and <br /> small scale are exempt from this section. <br /> Findin : The proposed project is an existing communications facility. <br /> Conclusion: This criterion is not applicable to tliis project. <br /> 10. To the extent provided by law, the City may require utility or communications service <br /> provider to allow up to two additional service providers to be located on shared facilities to <br /> discourage the proliferation of tower structures, consistent with technological feasibility. <br /> Findin : Permission for co-location oF another communications pfovider must be obtained from the <br /> BPA. <br /> Conclusion: The subjeci facility is not a potential site for the co-location of other communication <br /> facilities. <br /> 11. Uiility or communication facilities which require towers for which safety lights are required <br /> by the FAA shall not be permitted unless the applicant demonstrates that such a facility in <br /> tho proposed Iocation and at su� a height is necessary to adequately serve the needs of <br /> the public for the proposod utility or communications service. <br /> Findin : The proposed facility does not require safet�r lights by the FAA. <br /> Conclusion: The Applicant must comply with all FAA requirements for the operation of tl�e proposed <br /> facility. <br /> 5 <br />
