-11- <br /> • <br /> 1 shall be made for each proposal involving a <br /> major action unless the lead agency_has been pre- <br /> 2 viously determined, or the Responsible Official is <br /> aware that another agency is in the process of <br /> 3 determing the lead agency. A lead agency must <br /> be an agency with jurisdiction. <br /> 4 <br /> B. In those instances in which the City is the <br /> 5 lead agency, the Responsible Official shall super- <br /> vise the compliance with the threshold determina- <br /> 6 tion, and if an EIS is necessary, shall supervise <br /> preparation of the draft and final EIS, in accord- <br /> 7 and with Section 11 of this Ordinance. <br /> 8 C. In those instances in which the City is not the lead <br /> agency under the criteria of WAC 197-10-205 through <br /> 9 -270, the Responsible Official of the City, subject <br /> to the limitations of WAC 197-10-390 , -660, and -690 <br /> 10 shall utilize and consider as appropriate either the <br /> declaration of non-significance or the final EIS <br /> 11 of the lead agency in conjunction with the decisions <br /> of the City on the proposal . In such instances, <br /> 12 the Responsible Official shall not prepare or require <br /> preparation of a declaration of non-significance <br /> 13 or EIS in addition to that prepared by the lead <br /> agency. <br /> 14 <br /> D. In the event that the Responsible Official receives <br /> 15 a lead agency determination made by another agency <br /> which does not appear to be in accord with the <br /> 16 criteria of WAC 197-10-205 through -245 he may ob- <br /> ject thereto. Any such objection must be made and <br /> 17 resolved within fifteen (15) days of receipt of <br /> the determination, or the City must petition CEP <br /> 18 for a lead agency determination pursuant to WAC <br /> 197-10-260 within the fifteen (15) day time period. <br /> 19 Any such petition on behalf of the City shall be <br /> initiated by the Responsible Official . <br /> 20 <br /> 21 E. The Responsible Official is authorized to make <br /> agreements as to lead agency status pursuant to <br /> 22 WAC 197-10-240 and WAC 197-10-245 . <br /> 23 F. When the Responsible Official makes a lead agency <br /> determination for a private project he may require <br /> 24 such additional information from the applicant as <br /> necessary to ascertain which other agencies have <br /> 25 jurisdiction over the proposal . <br /> 26 Section 10. Environmental Checklist <br /> 27 A. Except as provided in WAC 197-10-300 (2) , a completed <br /> environmental checklist, or a copy thereof , substan- <br /> 28 tially in the form provided in WAC 197-10-365 shall <br /> be filed at the same time as, or before, an applica- <br /> 29 tion for a permit, license, certificate, or other <br /> entitlement for uses not specifically exempted herein. <br /> 30 This checklist shall be the basis for a determination <br /> by the City as to lead agency status, and if the City <br /> 31 is determined to be the lead agency, then for the <br /> threshold determination. <br /> 32 <br />
