-11- • 1 shall be made for each proposal involving a major action unless the lead agency_has been pre- 2 viously determined, or the Responsible Official is aware that another agency is in the process of 3 determing the lead agency. A lead agency must be an agency with jurisdiction. 4 B. In those instances in which the City is the 5 lead agency, the Responsible Official shall super- vise the compliance with the threshold determina- 6 tion, and if an EIS is necessary, shall supervise preparation of the draft and final EIS, in accord- 7 and with Section 11 of this Ordinance. 8 C. In those instances in which the City is not the lead agency under the criteria of WAC 197-10-205 through 9 -270, the Responsible Official of the City, subject to the limitations of WAC 197-10-390 , -660, and -690 10 shall utilize and consider as appropriate either the declaration of non-significance or the final EIS 11 of the lead agency in conjunction with the decisions of the City on the proposal . In such instances, 12 the Responsible Official shall not prepare or require preparation of a declaration of non-significance 13 or EIS in addition to that prepared by the lead agency. 14 D. In the event that the Responsible Official receives 15 a lead agency determination made by another agency which does not appear to be in accord with the 16 criteria of WAC 197-10-205 through -245 he may ob- ject thereto. Any such objection must be made and 17 resolved within fifteen (15) days of receipt of the determination, or the City must petition CEP 18 for a lead agency determination pursuant to WAC 197-10-260 within the fifteen (15) day time period. 19 Any such petition on behalf of the City shall be initiated by the Responsible Official . 20 21 E. The Responsible Official is authorized to make agreements as to lead agency status pursuant to 22 WAC 197-10-240 and WAC 197-10-245 . 23 F. When the Responsible Official makes a lead agency determination for a private project he may require 24 such additional information from the applicant as necessary to ascertain which other agencies have 25 jurisdiction over the proposal . 26 Section 10. Environmental Checklist 27 A. Except as provided in WAC 197-10-300 (2) , a completed environmental checklist, or a copy thereof , substan- 28 tially in the form provided in WAC 197-10-365 shall be filed at the same time as, or before, an applica- 29 tion for a permit, license, certificate, or other entitlement for uses not specifically exempted herein. 30 This checklist shall be the basis for a determination by the City as to lead agency status, and if the City 31 is determined to be the lead agency, then for the threshold determination. 32
