• <br /> -13- • • <br /> 1 the Draft EIS shall be deemed to have fulfilled <br /> the requirements of this Ordinance by utilizing <br /> 2 the services of a consultant included upon the <br /> certified consultants ' list, PROVIDED that the <br /> 3 Responsible Official delay distribution of the <br /> Draft EIS, when necessary, to correct any 4 defi- <br /> ciencies in the data submitted and that the con- <br /> sultant shall provide such information as is re- <br /> 5 quired under Section ll-A of this Ordinance . <br /> 6 3 . All fees and charges for said consultant shall <br /> be the responsibility of the applicant. <br /> 7 4 . The Responsible Official shall accept for 8 in- <br /> clusion upon the certified consultant list any <br /> person, firm, corporation, partnership or <br /> association which: <br /> 9 <br /> 10 a. Documents its expertise in engineering , <br /> planning, biology, zoology, geology, <br /> and other areas of analysis under <br /> 11 WAC 197-10-444 . <br /> 12 b. Where the firm has had previous experi- <br /> ence, provides one or more recommenda- <br /> 13 tions from the lead agency involved in <br /> the prior experiences . <br /> 14 <br /> 5. The Environmental Review Committee may, upon <br /> 15 notification to an affected firm, remove said <br /> firm from the consultants ' list for good cause, <br /> 16 including incompetence, misrepresentation, in- <br /> sufficiency, bias , or gross failure to perform <br /> 17 in accordance with this Ordinance . The firm <br /> shall have the opportunity to present arguments <br /> 18 to the Committee prior to Committee action. A <br /> motion for removal shall require five affirma- <br /> 19 tive votes . The firm may apply for re-instate- <br /> ment to the consultants '. list after one year and <br /> 20 shall be reinstated upon approval by a majority <br /> of Committee members. <br /> 21 <br /> 22 D. Consultant/Applicant Responsibilities <br /> 23 When a private applicant or consultant prepares <br /> a Draft EIS, the following responsibilities are <br /> 24 hereby specified: <br /> 25 1. City communicates and meets with the <br /> developer . <br /> 26 <br /> 27 2 . City communicates and meets with the consultant. <br /> 28 3 . Consultant submits information in the form of a <br /> draft EIS. <br /> 29 <br /> 4 . City reviews the draft EIS. <br /> 30 <br /> 31 <br /> 32 <br />
