• -13- • • 1 the Draft EIS shall be deemed to have fulfilled the requirements of this Ordinance by utilizing 2 the services of a consultant included upon the certified consultants ' list, PROVIDED that the 3 Responsible Official delay distribution of the Draft EIS, when necessary, to correct any 4 defi- ciencies in the data submitted and that the con- sultant shall provide such information as is re- 5 quired under Section ll-A of this Ordinance . 6 3 . All fees and charges for said consultant shall be the responsibility of the applicant. 7 4 . The Responsible Official shall accept for 8 in- clusion upon the certified consultant list any person, firm, corporation, partnership or association which: 9 10 a. Documents its expertise in engineering , planning, biology, zoology, geology, and other areas of analysis under 11 WAC 197-10-444 . 12 b. Where the firm has had previous experi- ence, provides one or more recommenda- 13 tions from the lead agency involved in the prior experiences . 14 5. The Environmental Review Committee may, upon 15 notification to an affected firm, remove said firm from the consultants ' list for good cause, 16 including incompetence, misrepresentation, in- sufficiency, bias , or gross failure to perform 17 in accordance with this Ordinance . The firm shall have the opportunity to present arguments 18 to the Committee prior to Committee action. A motion for removal shall require five affirma- 19 tive votes . The firm may apply for re-instate- ment to the consultants '. list after one year and 20 shall be reinstated upon approval by a majority of Committee members. 21 22 D. Consultant/Applicant Responsibilities 23 When a private applicant or consultant prepares a Draft EIS, the following responsibilities are 24 hereby specified: 25 1. City communicates and meets with the developer . 26 27 2 . City communicates and meets with the consultant. 28 3 . Consultant submits information in the form of a draft EIS. 29 4 . City reviews the draft EIS. 30 31 32
