• -18- <br /> • <br /> 1 4 . A threshold determination; <br /> 2 5 . Adoption of the final EIS, as to adequacy; <br /> 3 6 . Final action on a project or proposal, as <br /> to compliance with the provisions of this <br /> 4 Ordinance. <br /> 5 B. Any interested person shall have the right to appeal <br /> any of the determinations or actions described in <br /> 6 subsection (a) above. There shall be no right <br /> under this section to appeal to the Environmental <br /> 7 Review Committee any decisions of the City Council <br /> nor to appeal those actions where an appeal is other- <br /> 8 wise provided for or prohibited by the City Charter, <br /> other City Ordinance or State law. <br /> 9 <br /> 10 C. Notice of all determinations and actions described <br /> in Subsection (A) above shall be filed immediately <br /> 11 by the Responsible Official in the City ' s SEPA <br /> Public Information Center. Anv appeal from such <br /> 12 a determination or action must be filed in writing <br /> with the Environmental Review Committee no later <br /> 13 than the fifteenth day following the filing of such <br /> determination or action and shall set forth in a <br /> 14 clear and concise manner the errors complained <br /> of. <br /> 15 <br /> 16 D. Upon timely notice of appeal as to any determination <br /> or action set out in subsection (A) of this section, <br /> 17 the Environmental Review Committee shall set a date <br /> for hearing, which shall be not later than fifteen <br /> 18 days after receipt of such notice. Within five <br /> days after such hearing, the Environmental Review <br /> 19 Committee shall file and transmit to the parties <br /> written findings of fact, conclusion of law and <br /> 20 decision. <br /> 21 E. Any determination not so appealed shall become <br /> final; and any order so appealed shall not become <br /> 22 final until affirmed or modified by the Environmental <br /> Review Committee . <br /> 23 <br /> 24 F. Notice of hearing shall be sent by certified mail <br /> to the parties concerned and published in a news- <br /> 25 paper of general circulation as required by the <br /> administrative code for hearings in contested <br /> 26 cases. <br /> 27 G. Appeals shall be considered de novo except that <br /> the determination appealed from shall be regarded <br /> 28 as prima facie correct and the burden of establish- <br /> ing the contrary shall be upon the appealing party. <br /> 29 <br /> 30 H. The Environmental Review Committee shall have <br /> authority upon good cause to grant continuances <br /> 31 of hearings not to exceed fourteen days and fur- <br /> ther shall have authority to affirm, reverse <br /> 32 <br />
