1 I DOCUMENT 00 60 13—CONTRACT 1.1 GENERAL A. THIS CONTRACT is made and entered into this 17 day of oc-r06ER , 2018, by and between the City of Everett, Washington, a municipal corporation existing under the laws of the State of Washington, hereinafter called the "City," and Two 6f0t.p.M.. In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to furnish all labor,tools,materials,equipment,and supplies required to build and construct and to build and I construct in a workmanlike manner the Work, improvements, and appurtenances in accordance with the Specifications and Drawings entitled: "WPCF FEN Chlorination Building Upgrade (WO 3614)", (the "Project"). I 1.2 DEFINITIONS A. Contract Documents. The following documents ("Contract Documents") are incorporated by reference and are hereby made a part of this Contract: I 1. Notice to Bidders 2. Instructions to Bidders 3. General Conditions 4. Supplementary Conditions(if any) I 5. Drawings, Standard Plans, and Specifications 6. Addenda(if any) 7. Payment and Performance Bond I 8. Contractor's Bid Form 9. Other documents described as Contract Documents in Section 00 72 13, General Conditions 10. All provisions required by law whether set forth and reproduced herein or not. II B. Terms that are capitalized in a Contract Document but not defined in that Contract Document shall have the meaning defined to them in the other Contract Documents. I C. Contract Time. 1. See Section 01 11 00 for limitations and construction sequencing restrictions. 2. Substantial completion for portions of the Work as outlined in 01 11 00-1.6.A shall be completed on or before September 30,2019. 3. Substantial Completion of the entire Work shall be achieved on or before December 31, 2019. 4. Physical Completion shall be within 21 calendar days after the actual date of issuance of substantial completion. ID. Liquidated Damages—Work Performed Outside the Seasonal Restrictions. 1. The parties agree the City will suffer damage and be put to additional expense in the event that the Contractor does not complete the Work within the seasonal work sequence restrictions outlined in Section 01 11 00, even if the Work is still being done prior to the required date of Substantial Completion. I 2. Because it is difficult to accurately compute the amount of such costs and damages,the Contractor hereby covenants and agrees to pay to the City liquidated damages for each and every calendar day (or working day, if Contract Time is described in working days) in the amounts set forth in this Section.
