When he purchased it,there were three residential units on the property: 4212A,4212B,and 4212%. The first <br /> two units are an upstairs unit and basement unit in the principal structure at the front of the property; the third unit is in <br /> an accessory structure in the rear of the property. <br /> There was a code enforcement action on the basement unit (4212B)and the accessory structure unit in 2017. The <br /> residential units had not been legally permitted when Dr. Boyce purchased the property. There is a Hearing Examiner <br /> order(CE17-0400)that requires Dr. Boyce to abate the unpermitted basement unit. <br /> My understanding is that the code compliance issues with the accessory structure unit(4212%2)were resolved in July, <br /> 2017 when Permit No. CW1707-002 was finaled. However,there appears to be some confusion regarding the <br /> addressing, because this permit is listed under 4212B Rucker Ave. <br /> After looking through the historic permitting of the property and reviewing the EMC,we have concluded that there we <br /> cannot claim any legal non-conforming use status for the basement unit (4212B). We would therefore like to pursue <br /> abating the basement residential unit and reverting the use of the basement to the residential use in the principal <br /> structure. If, at some point in the future, Dr. Boyce wishes to pursue establishing residential use in the basement,we <br /> will go through the appropriate land use and building permitting process. <br /> I have confirmed with Grace Pollard that there is no land use process associated with the abatement.
