t { �. ( <br /> 5. The Examiner held that the respondent violated EMC § 8.20.020 (A) on July 1, <br /> 2010. The Respondents are repeat violators because they violated a similar Code <br /> chapter within the past twenty-four months. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 1. The Respondents shall abate all violations of EMC 8.20.020 (A)and (G) nuisance <br /> violations, IRC§ R105.1 permits required, and IPMC §404.3, 404.4.4, 108.1.5.1 and <br /> 108.1.3 unfit for human occupancy, on the property located at 1101 E. Marine View <br /> Drive, Everett, Washington. <br /> 2. All abatement of the violations on the above mentioned property shall be completed <br /> according to the following schedule. Cleanup and abatement shall include: <br /> a. The Respondents are required to remove and properly dispose of all discarded <br /> junk, trash, litter, and vehicle parts from the property by August 6, 2012. <br /> b. The Respondents are required to submit plans and a building permit application <br /> no later than August 27, 2012 for the conversion of the cellar to allow review, <br /> inspections and approval, and complete the work and receive a final inspection <br /> from the City of Everett Building Division, no later than October 27, 2012 or; <br /> c. Secure a deconstruction permit and deconstruct the deck and garage, and <br /> receive final inspection from the City of Everett Building Division no later than <br /> October 27, 2012. <br /> 3. The Respondent, Andrew Armitage shall pay a total fine of$2,500.00, $1,000.00 for <br /> violation of EMC 8.20.020 (A), because the Respondent is a repeat violator as <br /> defined in EMC 1.20.010(E), and $500.00 each for violation of EMC §8.20.020 (0), <br /> IRC §R105.1, and $500.00 for violation of a structure unfit for human occupancy <br /> pursuant to IPMC §404.3, 404.4.4, 108.1.5.1 (1), and 108.1.3. <br /> 4. The Respondents shall not violate any ordinance set forth in EMC §1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, <br /> for the next twenty-four (24) months. <br /> 5. The Respondent, Andrew Armitage shall Day the $2.500.00 fine no later than <br /> August 10. 2012. Payment shall be made to the City of Everett Treasurer at 2930 <br /> Wetmore Suite 100, Everett Washington, 98201. If payment is not made on or <br /> before August 10, 2012, collection action will be taken, which may include assigning <br /> the debt to a collection agency pursuant to EMC §1.20.050(D). <br /> 6 <br />
