IPMC§404.3: Habitable spaces hallways, corridors, laundry areas, bathrooms, toilet <br /> moms and habitable basement areas, shall have a clear ceiling height of not less <br /> than 7 feet. <br /> 4. IPMC§404.4.4: Kitchens and non-habitable spaces shall not be used for sleeping <br /> purposes. <br /> 5. IPMC§108.1.5.1(1): Any door, aisle, passageway, stairway, exit or other means of <br /> egress that does not conform to the approved building or fire code of the jurisdiction <br /> as related to the requirements of existing buildings. <br /> 6. IPMC§108.1.3: A structure is unfit for human occupancy whenever the code official <br /> finds that such structure is unsafe, unlawful or, because of the degree to which the <br /> structure is in disrepair or lacks maintenance, is unsanitary, vermin or rat infested, <br /> contains filth and contamination, or lacks ventilation, illumination, sanitary or heating <br /> facilities of other essential equipment required by this code, or because the location <br /> of the structure constitutes a hazard to the occupants of the structure or to the <br /> public. <br /> 7. EMC§1.20.010(E): "Repeat violator"means any person, firm, corporation, <br /> association, or agent thereof who has had any order issued pursuant to the <br /> provisions in this chapter, including any order issued subsequent to a hearing, any <br /> stipulated order and any default order, and within twenty-four months of the <br /> issuance of such order commits or allows to be committed a new and separate <br /> violation of a same or similar chapter of the Everett Municipal Code that is <br /> enforceable under this chapter, regardless of location. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By maintaining the property with junk, trash, litter, lumber and other similar debris <br /> discarded on the above mentioned property, the Respondents Karen D. Loth and <br /> Andrew G. Armitage have violated EMC §8.20.020 (A). This violation is a public <br /> nuisance. <br /> 2. By maintaining the property with vehicle parts discarded on the above mentioned <br /> property, the Respondents Karen D. Loth and Andrew G. Armitage have violated <br /> EMC § 8.20.020(G). This violation is a public nuisance. <br /> 3. By allowing the cellar to be converted to living space without benefit of permits on <br /> the above mentioned property, Respondents Karen D. Loth and Andrew G. <br /> Armitage have violated IRC § R105.1. <br /> 4. By allowing the unlawfully converted cellar to be occupied for residential purposes <br /> in the above mentioned property, Respondents Karen D. Loth and Andrew G. <br /> Armitage have violated IPMC § 403.3, 404.4.4, 108.1.5.1. The property is <br /> condemned as unfit for human occupancy pursuant to IPMC §108.1.3. <br /> 5 <br />
