She informed the bank <br /> and told them that extensive remodeling had been done without permits and that <br /> the work was very poor. According to the information provided to Code Officer <br /> Fagerstrom she stated that the house was in such poor condition she thought that it <br /> should be torn down. (Testimony of Code Enforcement Officer Fagerstrom) <br /> 10. On July 1, 2010 the Respondents had violated a similar chapter of the EMC as <br /> alleged with the instant case. The Everett Hearings Examiner determined that the <br /> Respondent had violated EMC Section 8.20.020 (A)because the Respondents <br /> maintained the property with discarded junk, trash, litter and other similar debris in <br /> the yards. The Hearings Examiner decision was not appealed. (Exhibit#8, Final <br /> Findings of Fact, Conclusion of Law and Order of the Hearing Examiner Case#90- <br /> 0571 dated July 1, 2010) (Testimony of Code Enforcement Officer Fagerstrom) <br /> 11. The Respondents were given the opportunity to correct the conditions and received <br /> adequate notice to appear at this hearing to contest the City's findings. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any EMC provision that identifies Chapter 1.20 EMC <br /> for enforcement, the Violations Hearing Examiner of the City of Everett has jurisdictional <br /> authority to hold this hearing and to issue the decision. EMC §1.20.020 <br /> Applicable Law: <br /> 1. EMC§ 8.20.020: No person owning, leasing, renting, occupying or having charge or <br /> possession of any property in the city, including vacant lots, shall maintain or allow <br /> to be maintained on such property except as may be allowed by any other city <br /> ordinance any of the following conditions visible from any public street, alley or <br /> other public or private property; <br /> (A) Junk, trash, litter, boxes, discarded lumber, salvage materials or other similar <br /> materials in any front yard, side yard, rear yard or vacant lot; <br /> (G) Vehicle parts and/or other articles of personal property which are discarded or <br /> left in a state of partial construction or repair in the front yard, side yard, rear <br /> yard or vacant lot; <br /> 2. !RC§R105.1: Any owner or authorized agent who intends to construct, enlarge, <br /> alter, repair, move, demolish or change the occupancy of a building or structure, or <br /> to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br /> mechanical or plumbing system, the installation of which is regulated by this code, <br /> or cause any such work to be done, shall first make application to the building <br /> official and obtain the required permit. <br /> 4 <br />
