EVERETT <br /> WASHINGTON <br /> ORDINANCE NO. 3676-19 <br /> An Ordinance Amending the Critical Area Regulations of the Zoning Code to Apply <br /> City-wide, Including Areas Within Jurisdiction of the Shoreline Master Program and <br /> Local Project Review Procedures,Amending Ordinance Nos. 1671-89,2909-06 and <br /> 2530-01,as Amended <br /> WHEREAS, the Planning Commission recommended amendments to the standards and <br /> development regulations in the Zoning Code for critical areas (Planning Commission <br /> Resolution Nos. 19-04 and 19-05); <br /> WHEREAS,the City of Everett is considering amendments to the Shoreline Master Program (SMP), <br /> which contains critical area regulations that apply uniquely to areas within shoreline jurisdiction; <br /> WHEREAS,the existing critical area regulations contained within the SMP are inconsistent with the <br /> regulations and standards applicable to the remainder of the City, resulting in different buffer <br /> requirements for streams and wetlands, and have been determined to be less protective of the <br /> functions and values of the critical areas in shoreline areas; <br /> WHEREAS,the SMP critical area regulations will be repealed as part of the amendment package for <br /> the SMP; <br /> WHEREAS, adoption of the revised SMP will occur after adoption of amended critical area regulations <br /> and the new critical area regulations will not be effective for areas within shoreline jurisdiction until <br /> the City and Department of Ecology adopt the revised SMP; <br /> WHEREAS,the amendments to the SMP and critical area regulations will require additional <br /> amendments to Title 19 (Zoning) and Title 15 (Local Project Review Procedures)for consistency; <br /> WHEREAS,the Growth Management Act requires periodic review of development regulations, <br /> including those applying to critical areas; <br /> WHEREAS,the Everett Comprehensive Plan includes goals, objectives and policies requiring the city <br /> to: adopt and update critical area regulations; protect critical area features; and implement Best <br /> Available Science; <br /> WHEREAS, RCW 36.70.A.172 requires that jurisdictions include Best Available Science in developing <br /> policies and development regulations to protect the functions of critical areas and give special <br /> EMC Title 19.37 (Critical Areas) Page 1 <br />
