EVERETT WASHINGTON ORDINANCE NO. 3676-19 An Ordinance Amending the Critical Area Regulations of the Zoning Code to Apply City-wide, Including Areas Within Jurisdiction of the Shoreline Master Program and Local Project Review Procedures,Amending Ordinance Nos. 1671-89,2909-06 and 2530-01,as Amended WHEREAS, the Planning Commission recommended amendments to the standards and development regulations in the Zoning Code for critical areas (Planning Commission Resolution Nos. 19-04 and 19-05); WHEREAS,the City of Everett is considering amendments to the Shoreline Master Program (SMP), which contains critical area regulations that apply uniquely to areas within shoreline jurisdiction; WHEREAS,the existing critical area regulations contained within the SMP are inconsistent with the regulations and standards applicable to the remainder of the City, resulting in different buffer requirements for streams and wetlands, and have been determined to be less protective of the functions and values of the critical areas in shoreline areas; WHEREAS,the SMP critical area regulations will be repealed as part of the amendment package for the SMP; WHEREAS, adoption of the revised SMP will occur after adoption of amended critical area regulations and the new critical area regulations will not be effective for areas within shoreline jurisdiction until the City and Department of Ecology adopt the revised SMP; WHEREAS,the amendments to the SMP and critical area regulations will require additional amendments to Title 19 (Zoning) and Title 15 (Local Project Review Procedures)for consistency; WHEREAS,the Growth Management Act requires periodic review of development regulations, including those applying to critical areas; WHEREAS,the Everett Comprehensive Plan includes goals, objectives and policies requiring the city to: adopt and update critical area regulations; protect critical area features; and implement Best Available Science; WHEREAS, RCW 36.70.A.172 requires that jurisdictions include Best Available Science in developing policies and development regulations to protect the functions of critical areas and give special EMC Title 19.37 (Critical Areas) Page 1
