consideration to conservation or protection measures necessary to preserve or enhance anadromous <br /> fisheries; <br /> WHEREAS, Best Available Science is reflected in the critical area code amendments through inclusion <br /> of the latest guidance from the Department of Ecology regarding wetland buffers, alteration criteria <br /> and mitigation requirements; <br /> WHEREAS,the City sought review and input from the Washington State Department of Ecology, <br /> property owners and the Port of Everett during project scoping and drafting of the amendments; <br /> WHEREAS, EMC 19.41.170(C) provides,for zoning code text amendments if it finds that: 1)The <br /> proposed amendment is consistent with the applicable provisions of the Everett general plan <br /> . [comprehensive plan]; and 2)The proposed amendment bears a substantial relation to public health, <br /> safety or welfare; and 3)The proposed amendment promotes the best long term interests of the <br /> Everett community; <br /> WHEREAS,the proposed amendments to the City's critical areas regulations will implement code <br /> streamlining objectives by improving the code's format and reducing duplication; and <br /> WHEREAS,the Planning Commission conducted public briefings on December 18, 2018 and January <br /> 15, 2019, to discuss and consider potential amendments to critical area regulations; and <br /> WHEREAS, a SEPA Determination of Non-Significance (DNS) was issued for the proposed amendments <br /> to the critical area regulations on January 15, 2019;and <br /> WHEREAS, legal notice of the City Council public hearing was timely published in The Herald; <br /> WHEREAS,the City Council held a public hearing on May 15, 2019 to consider public testimony and <br /> complete a review of the suggested amendments; <br /> WHEREAS,the proposed amendments to the City's critical area regulations bear a substantial relation <br /> to public health, safety or welfare; <br /> WHEREAS,the proposed code amendments promote the best long term interests of the Everett <br /> community; and <br /> WHEREAS,the proposed amendments to the City's critical area regulations will not create a probable <br /> significant adverse environmental impact and would not require mitigation measures under the City's <br /> SEPA policies in EMC Title 20.04. <br /> EMC Title 19.37 (Critical Areas) Page 2 <br />
