OLT <br /> PLANNING COMMISSION RESOLUTION NO. 19-04 <br /> A Resolution recommending that the City Council amend the critical area regulations <br /> in Chapter 19.37(Zoning)of the Everett Municipal Code to apply citywide, including <br /> areas within jurisdiction of the Shoreline Master Program <br /> WHEREAS,the Planning Commission finds the following: <br /> 1. The City of Everett is adopting amendments to the Shoreline Master Program (SMP); and <br /> 2. The existing SMP contains critical area regulations that apply uniquely to areas within shoreline <br /> jurisdiction; and <br /> 3. The existing critical area regulations contained within the SMP are inconsistent with the <br /> regulations and standards applicable to the remainder of the city, resulting in different buffer <br /> requirements for streams and wetlands; and <br /> 4. The SMP critical area regulations will be repealed as part of the amendment package for the <br /> SMP; and <br /> 5. The Growth Management Act (Act) requires periodic review of development regulations, <br /> including those applying to critical areas; and <br /> 6. The Everett Comprehensive Plan includes goals,objectives and policies requiring the city to: <br /> adopt and update critical area regulations; protect critical area features; and implement Best <br /> Available Science; and <br /> 7. RCW 36.70.A.172 requires that jurisdictions include Best Available Science in developing <br /> policies and development regulations to protect the functions of critical areas and give special <br /> consideration to conservation or protection measures necessary to preserve or enhance <br /> anadromous fisheries; and <br /> 8. Best Available Science is reflected in the critical area code amendments through inclusion of <br /> the latest guidance from the Department of Ecology regarding wetland buffers, alteration <br /> criteria and mitigation requirements; and <br /> 9. The City of Everett sought review and input from the Washington State Department of Ecology <br /> during project scoping and drafting of the amendments. The city worked collaboratively to <br /> address local property owners and the Port of Everett; and <br /> Planning Commission Resolution 19-04 Page 1 <br /> Critical Areas March 19, 2019 <br />
