10. EMC 19.41.170(C) provides for zoning code text amendments if it finds that: 1)The proposed <br /> amendment is consistent with the applicable provisions of the Everett general plan <br /> [comprehensive plan]; and 2)The proposed amendment bears a substantial relation to public <br /> health, safety or welfare; and 3)The proposed amendment promotes the best long term <br /> interests of the Everett community; and <br /> 11. The proposed amendments to the City's critical areas regulations will implement code <br /> streamlining objectives by improving the code's format and reducing duplication; and <br /> 12. The Planning Commission conducted public briefings on December 18, 2018 and January 15, <br /> 2019,to discuss and consider potential amendments to critical area regulations;and <br /> 13. A SEPA Determination of Non-Significance (DNS) was issued for the proposed amendments to <br /> the critical area regulations on January 15, 2019; and <br /> 14. Legal notice was published on January 18, 2019 in The Herald giving notice of a 15-day <br /> comment period,SEPA determination/comment period, and notice of intent to adopt to the <br /> Washington State Department of Commerce; and <br /> 15. The Planning Commission held a public hearing on February 19, 2019 to consider public <br /> testimony and complete a review of the suggested amendments and staff report and prepare <br /> recommendations for the City Council's consideration. <br /> And, WHEREAS,the Planning Commission concludes the following: <br /> 1. The City has conducted a thorough and appropriate public participation process consistent <br /> with the state grant agreement to generate interest and solicit feedback concerning desired <br /> amendments to the existing Shoreline Master Program; and <br /> 2. The proposed amendments to the city's critical area regulations bear a substantial relation to <br /> public health, safety or welfare; and <br /> 3. The proposed code amendments promote the best long term interests of the Everett <br /> community; and <br /> 4. The proposed amendments to the city's critical area regulations will not create a probable <br /> significant adverse environmental impact and would not require mitigation measures under <br /> the City's SEPA policies in EMC Title 20.04. <br /> Planning Commission Resolution 19-04 Page 2 <br /> Critical Areas March 19, 2019 <br />
