ORDINANCE No. 3678-19 ePosA%fmNAm <br /> AN ORDINANCE Relating to Limited <br /> Commission Officers, amending <br /> Ordinance No. 284-74 (Chapter 2.48 EMC). <br /> Whereas, Ordinance No. 284-74 concerning appointment of limited and specially <br /> commissioned officers has not been updated since first adopted in 1974 and State law concerning <br /> limited and special commissions has changed; and <br /> Whereas,there are instances within the City limits where a limited commissioned officer <br /> can provide for public health, safety and the enforcement of civil infractions to maintain the <br /> public good; and <br /> Whereas, there is unique property and circumstances within the City 1 imits and <br /> contiguous to other municipalities where the use of limited commission officers will provide for <br /> public health, safety, and welfare; and <br /> Whereas,the City Council deems it appropriate to amend the authority of the chief of <br /> police to appoint limited commission officers pursuant to state law; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Sections 1 through 9 of Ordinance No. 284-74 (Chapter 2.48 EMC), which reads as <br /> follows: <br /> Section 1: Appointments <br /> The Chief of Police may in his discretion appoint special policemen pursuant to the <br /> requirements, terms and conditions of this ordinance and the Charter of the City of Everett. All <br /> such appointments must be approved by the City Council. <br /> Section 2: Qualifications <br /> (a) There shall be a criminal record check for each applicant for special policeman, and each <br /> such applicant must have as clear a criminal record check as required for entering regular police <br /> officers of the City of Everett. <br /> (b) Each special policeman shall have at least one year law enforcement experience or its <br /> equivalent as may be approved by the Chief of Police. <br /> (c) Each special policeman shall be at least twenty-one (21) years of age. <br /> Section 3: <br /> Each special policeman applicant, or his employer, must show the need and necessity for <br /> the issuance of a special police commission. <br />
