4. Violations& EMC Sections <br /> Inspection of the property reveals the following conditions and violations: <br /> The structure located on the property is functioning as a 2 unit duplex. Multi- family <br /> units are not permitted within the R-1. zone. There is no evidence contained within the <br /> records of either the Planning Department, nor the Building Division showing that any <br /> approvals were sought, or granted for this use. This is a violation of Everett <br /> Municipal Code 19.5.010 which reads; <br /> Land uses which are listed in the use table of this chapter shall be permitted <br /> subject to the review process listed in the table for a specific use in a particular <br /> use zone, If a use is not listed specifically or generally in a specific zone in the <br /> use table, it shall be considered to be a prohibited use in that zone, See Section <br /> 2.080(D)(2) for information on planning director interpretations on uses which <br /> are not listed in the use tables (Ord. 2397-99§36(part), 1999: Ord, 1671-89 <br /> (part), 1989.) <br /> The alteration of the structure there, requires a permit. There are no records found <br /> within the Building Division's files showing that any permits were ever applied for, or <br /> issued for this work. This is a violation of International Residential Code 105.1 <br /> which reads; <br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br /> move, demolish or change the occupancy of a building or structure, or to erect, <br /> install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br /> mechanical or plumbing system, the installation of which is regulated by this <br /> code, or cause any such work to be done, shall first make application to the <br /> building official and obtain the required permit. <br /> This condition renders the structure unlawful. This is a violation of International <br /> Property Maintenance Code (IPMC) 108.1.4 which reads; <br /> An unlawful structure is one found in whole or in part to be occupied by more <br /> persons than permitted under this code, or was erected, altered or occupied <br /> contrary to law. <br /> The IPMC is adopted by the City of Everett. Violations of the IPMC are unlawful in <br /> accordance with Section 106.1 which reads; <br /> It shall be unlawful for a person, firm or corporation to be in conflict with or in <br /> violation of any provisions of this code, <br /> Everett Police Depai lment,Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 <br />
