Ted Budden <br /> From: Ted Budden <br /> Sent: Tuesday, May 03, 2016 1:52 PM <br /> To: Donald Cunningham <br /> Subject: RE:4223 S 3rd Ave <br /> Don, <br /> I agree with your analysis and summary of the records and documents concerning the unpermitted and unlawful <br /> alterations and occupancy of the detached garage at 4223 S 3rd <br /> The records clearly indicate that the garage structure has been and is currently in violation of code. <br /> The garage structure has never received required approvals for the alterations and change of use that has occurred. <br /> The structure is an Unlawful Structure as defined by the IPMC.This structure does not meet minimum code standards <br /> and should not be occupied. <br /> During the inspection I conducted with you yesterday I observed additional code concerns related to the main house as <br /> follows. <br /> A sleeping loft has been created by altering the house attic for this purpose,this sleeping loft is accessed by a built in <br /> ladder.The sleeping loft lacks an approved Emergency escape opening as required by section 702.4 of the IPMC. <br /> The underfloor has apparently been altered for use as a laundry for the tenants as stated to us by the occupant of the <br /> detached "garage" structure.Access to the underfloor and laundry area is beneath the exterior deck that is attached to <br /> the east side of the house.The ceiling height or headroom to access this area is lower than the code required minimum <br /> of 6ft 8 inches. <br /> Additionally,your attached tax assessor photos show that the front entry has been moved from the original location at <br /> the street side of the structure. <br /> I have researched file records for permits and approvals for these alterations.
