For this project,the steep slope is approximately <br /> 90-100ft tall,which would require the detention pond to be set back that same distance from the top of the steep slope. <br /> The engineer has used the NGPA boundary,which is at the top of the steep slope, as their limit for construction.Thus, <br /> the detention pond is set exactly at the top of the steep slope.Although this section was highlighted each time we gave <br /> comment letters back, it was not explicitly called out until our last round of review when we decided that the engineer <br /> clearly wasn't addressing everything we were intending for them to address in their pickups.The engineer is now trying <br /> to push back against our setback requirement stating that he has never seen such a requirement for a setback from any <br /> other jurisdiction. Paul McKee (permit services manager) has asked him to pull together examples from other <br /> jurisdictions for our collective review.We are internally discussing our requirements of this setback to see if we can <br /> come up with a collective City response for the engineer.We were hoping that items like this (requirements from our <br /> Stormwater Management Manual and the Planned Action Determination for the project would have been addressed <br /> during your third party review.Although we received great comments and feedback from you,there was not a definitive <br /> engineering response regarding these specific criteria and it has led the engineer to believe that you/HWA finds the <br /> pond location at the top of the steep slope adequate and of little concern.Attached please find a copy of the <br /> development team's geotechnical engineering responses to your comments. Please let me know if you have any <br /> questions or additional concerns.
