EVERETT WASHINGTON ORDINANCE NO. 3680-19 AN ORDINANCE updating the Shoreline Master Program and removing the Shoreline Land Use Element from the Comprehensive Plan, amending Ordinance Nos. 2600-02 and 2021-94, as amended. WHEREAS,the Shoreline Management Act requires coastal cities and counties to develop and administer a Shoreline Master Program (SMP); and WHEREAS,the City of Everett first adopted a SMP in 1976, which was last amended with an effective date of July 11, 2016; and WHEREAS, RCW 90.58.080(4) requires the City of Everett to review and, if necessary, revise the SMP on or before June 30, 2019; and WHEREAS,the review process is intended to bring the SMP into compliance with requirements of the act or state rules that have been added or changed since the last SMP amendment, ensure the SMP remains consistent with the comprehensive plan and development regulations, and incorporate amendments deemed necessary to reflect changed circumstances, new information, or improved data; and WHEREAS,the Growth Management Act, RCW 36.70A.580, provides that the goals and policies of the SMP shall be considered an element of the City's comprehensive plan, and the other portions of the SMP shall be considered part of the City's development regulations; and WHEREAS, a Shoreline Public Participation Plan was prepared and followed to ensure early and continuous public outreach and key stakeholder involvement in the periodic review of the SMP, including the formation of a 15-member Shoreline Advisory Committee; and WHEREAS,the Shoreline Advisory Committee met five times in 2018, maintained a project webpage, and hosted a community meeting to share the proposed future vision for shoreline areas as well as gather public input; and WHEREAS, the City of Everett used the Washington State Department of Ecology's checklist of legislative and rule amendments to review amendments to chapter 90.58 RCW and state guidelines that have occurred since the last comprehensive update of the SMP and to determine if local amendments are needed to maintain compliance in accordance with WAC 173-26- 090(3)(b)(i); and 1
