WHEREAS,the City of Everett reviewed changes to the comprehensive plan and development <br /> regulations to determine if the SMP policies, designations, and regulations remain consistent <br /> with them in accordance with WAC 173-26-090(3)(b)(ii); and <br /> WHEREAS,the City of Everett considered any amendments needed to reflect changed <br /> circumstances, new information or improved data in accordance with WAC 173-26-090(3)(b)(iii); <br /> and <br /> WHEREAS,the City of Everett consulted with the Washington State Department of Ecology early <br /> and often during project scoping and drafting of the amendments and worked collaboratively <br /> with Ecology to address local and tribal interests while ensuring the proposed amendments are <br /> consistent with the policy of RCW 90.58.020 and applicable guidelines in accordance with WAC <br /> 173-26-104; and <br /> WHEREAS, a combined legal notice was published on January 15, 2019, in The Herald giving <br /> notice of a 30-day comment period,SEPA determination/comment period, notice of intent to <br /> adopt to the Washington State Department of Commerce, and notice of a joint public hearing <br /> with the Washington State Department of Ecology; and <br /> WHEREAS, a SEPA Determination of Non-Significance (DNS) was issued for the periodic update <br /> to the Shoreline Master Program on January 15, 2019; and <br /> WHEREAS,the Planning Commission held a joint public hearing with the Washington State <br /> Department of Ecology pursuant to WAC 173-26-104 on February 19, 2019, to consider public <br /> testimony and completed a review of the Shoreline Advisory Committee and staff <br /> recommendations and prepared initial amendments; and <br /> WHEREAS,the Office of Community, Planning and Economic Development is authorized to <br /> determine, in consultation with the City Clerk and the City Attorney, the format for publication <br /> of the approved Shoreline Master Program and have consistently prepared a stand-alone <br /> document containing all the required elements; and <br /> WHEREAS,the Planning Commission adopted a resolution on March 19, 2019, recommending <br /> the City Council approve amendments to the Shoreline Master Program, and repeal the <br /> comprehensive plan and zoning references that are redundant and duplicate portions of the <br /> stand-alone document; and <br /> WHEREAS,the City Council has conducted a public hearing to consider the recommendations of <br /> the Planning Commission; and <br /> WHEREAS, after considering all public comments and evidence, the City Council determined that <br /> the proposed amendments comply with all applicable laws and rules; and <br /> WHEREAS,this completes the City's required process for periodic review in accordance with <br /> RCW 90.58.080(4) and applicable state guidelines in WAC 173-26. <br /> 2 <br />
