ADDENDUM TO THE CONCOMITANT CONTRACT <br /> TO REZONE ORDINANCE NO. 372-75 <br /> THIS AGREEMENT IS MADE this day of\ ; -c;1,444%12/9 1987, by <br /> and between the City of Everett, a municipal corporation under the laws of <br /> the State of Washington, hereinafter referred to as "City" and Prudential <br /> Bank, hereinafter referred to as "Owner," and Michael B. Elton and William <br /> E. Colson, hereinafter referred to as "Option Holders." <br /> WITNESSETH: <br /> WHEREAS, Wesley G. Ingrum executed a contract agreement, hereinafter <br /> referred to as "Agreement," whereby Mr. Ingrum agreed to develop his <br /> property, a legal description of which is attached hereto as Exhibit A and <br /> incorporated herein by reference, in accordance with the standards and <br /> conditions set forth in the Agreement; and <br /> WHEREAS, the Agreement is concomitant to rezone Ordinance No. 372-75; <br /> and <br /> WHEREAS, the Agreement runs with the land and is binding on Wesley G. <br /> Ingrum and his successors in interest; and <br /> WHEREAS, Wesley G. Ingrum no longer owns the property subject to the <br /> Agreement which property is now owned by the Owner described above and Elton <br /> and Williams have an interest in the property as option holders; and <br /> WHEREAS, Option Holders have revised the proposal and are seeking to <br /> have some of the conditions of the Agreement amended; <br /> NOW, THEREFORE, the City, Owner and Option Holders mutually agree as <br /> follows: <br /> II <br /> 1. Requirement 1 of the Agreement is amended to read as <br /> follows: All development on the site shall be in <br /> accordance with the site plan which is attached hereto <br /> as Exhibit B and incorporated herein by reference. Any <br /> variations to these plans must receive approval from <br /> the Planning Director and if the Planning Director <br /> deems such variations major, they shall be approved <br /> only after a public hearing before the Hearing Examiner. <br />
