r <br /> 1 <br /> 2. Requirement 2 of the Agreement is amended to read as <br /> follows: The site must be developed with a congregate <br /> care facility, which meets the following standards: <br /> II <br /> a. The age of residency in the facility must be a <br /> minimum of 60 years old, with the exception of a <br /> younger spouse; <br /> b. At least one meal per day must be taken in a <br /> common dining area and must be required as part <br /> of the fee structure; <br /> c. Unit size must be less than what is normally <br /> needed for one family unit; and <br /> d. All central services facilities are to be used by <br /> the tenants and guests and are not to be open to <br /> the general public. <br /> Density standards do not apply and parking requirements <br /> are .5 spaces per unit. <br /> 3. Requirement 4 of the Agreement is hereby deleted in its <br /> entirety. <br /> 4. Requirement 6 of the Agreement is hereby deleted in its <br /> entirety. <br /> I 5. Requirement 7 of the Agreement is amended to read as <br /> �! follows: <br /> Storm drainage improvements must be provided in <br /> compliance with Ordinance 670-80, as amended. On—site <br /> detention is required; or, in lieu of providing on—site <br /> detention, payment to City Drainage Fund 340 is allowed. <br /> 6. Requirement 11 of the Agreement is hereby deleted in <br /> i! its entirety. <br /> Ii <br /> ji 7. The Agreement is hereby amended by the addition of the <br /> following: <br /> a. All development on the site must be in compliance <br /> with the SEPA Determination of Non—Significance <br /> #61-87 issued for the proposal. <br /> b. Binding Effect. That the provisions of this <br /> HAgreement shall be binding upon and enforceable <br /> against said Owner, Option Holders, the <br /> Owner's/Option Owner's, successors and assigns <br /> and all subsequent owners, their respective <br /> heirs, successors and assigns, of the property <br /> herein described. <br /> c. Change of Ownership. That, in the event there is <br /> a change in ownership, it is the responsibility <br /> of the new owner to notify the City's Planning <br /> Department in writing within ten (10) days of the <br /> effective date of the change. <br /> I I <br /> —2— <br /> I! <br />
